Intellectual Property law is a dynamic field; its ever-changing landscape challenges us to constantly revisit the existing laws and policies. Although ideological currents of a second-tier patent (STP) regime are sweeping through the South Asian region in recent years, the concept of utility model or petty patent remains a largely unexplored option in Sri Lanka and in other parts of the South Asian region. This book analyses the impact of CAFTA-DR and European Free Trade Agreements on the industrial property system in Central America. While there is ample literature on bilateral and regional FTAs, it is often limited to the contractual obligations assumed by the participating countries. This book goes a step further and analyses how these obligations are implemented through national legislation, institutional changes and legal practice. To provide a deeper understanding of the effects of FTAs on national IP systems, the book addresses research questions that go beyond general publications on the topic. Research questions include: Is the combination of market access and IP rules in a bilateral FTA an effective and appropriate trade deal? How are the IP requirements under the FTAs implemented into the national statutory framework? Do the IP rules of FTAs sufficiently address institutional factors necessary for an effective IP system? Technology is key to the development of nations yet is not freely or easily accessible. This book aims to contribute to the debate about empowering Africa to play a more meaningful role in the global innovation system. It emphasizes the important role of technology transfer in assisting Least Developed Countries (LDCs) in Africa to expand their technological capabilities. The book surveys IP and innovation policies in Africa's past and present, providing theoretical, policy, and legal frameworks, as well as specific measures that will help African LDCs. It proposes solutions to overcome challenges currently posed by inefficiencies in the flow of technologies to LDCs and by the fragmentation of the international legal framework that regulates technology transfer. Notably, the book proposes maximal implementation of the TRIPS Agreement provisions related to technology transfer and recommends the adoption of a uniform international legal instrument under the framework of the WTO to be designated as the Agreement on Trade-Related Issues of Technology Transfer and Innovation (TRITTI). The book advocates for proactivity from African LDCs and urges them to cultivate environments that attract and enable technology transfer into their respective states. This will facilitate technological learning, accelerate absorption and adaptation fit to an African context, and will catapult African LDCs down the road of innovation.

The SME Policy Index is a benchmarking tool for emerging economies to monitor and evaluate progress in policies that support small and medium-sized enterprises. The ASEAN SME Policy Index 2018 is a joint effort between the Economic Research Institute for ASEAN and East-Asia (ERIA), the Organisation for Economic Co-operation and Development (OECD) and the ASEAN Coordinating Committee on Micro, Small and Medium Enterprises (ACCMSME). The report is the outcome of work conducted by the ten ASEAN Member States (Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, the Philippines, Singapore, Thailand and Viet Nam). Divided into eight policy dimensions, it builds on the previous edition of the ASEAN SME Policy Index 2014. The current edition presents an updated methodology which makes this document a powerful tool to assess the strengths and weaknesses that exist in policy design, implementation, and monitoring and evaluation for SMEs, and allows for a benchmarking of the level to which the ASEAN Strategic Action Plan for SME Development (SAP SMED) 2016-2025 has been implemented. Its objective is to enhance the capacity of policy makers to identify policy areas for future reform, as well as implement reforms in accordance with international good practices. The report provides a regional perspective on recent developments in SME-related policies in Southeast Asia as well as in individual ASEAN Member States. Small and medium-sized enterprises (SMEs) account for about 97–99 per cent of total enterprises and 60–80 per cent of total employment in ASEAN countries. The participation of SMEs is thus crucial for achieving greater regional economic integration amongst ASEAN countries. SMEs are, however, often constrained by many disadvantages that limit their abilities to become importers and exporters. This is well documented in the research literature on trade and firm size.
