Intellectual Property law is a dynamic field; its ever-changing landscape challenges us to constantly revisit the existing laws and policies. Although ideological currents of a second-tier patent (STP) regime are sweeping through the South Asian region in recent years, the concept of utility model or petty patent remains a largely unexplored option in Sri Lanka and in other parts of the South Asian region. Against this backdrop, this book offers an alternative approach to incentivise minor and incremental innovations of SMEs. It also explores whether Sri Lanka and other developing economies in the South Asian region can benefit from such an STP regime if it is tailored to the specific characteristics of the innovation landscape of the country.

Dilemmas Of Intellectual Property Discourse In Sri Lanka written by Asanka Perera and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-08-21 with Law categories.

This book examines global and national lawmaking in Sri Lanka through three case studies: patent examination, plant variety laws, and technology innovation. It evaluates how various lawmakers influence intellectual property law to support innovation and development in Sri Lanka. The book explores Sri Lanka’s intellectual property laws and the mismatch between its international obligations, such as Trade Related Aspects of Intellectual Property Agreement (TRIPS), and the Patent Cooperation Treaty (PCT), and their implementation. It examines the repercussions of this mismatch and provides insights for the future of Sri Lanka and other small developing countries. Based on socio-legal research, the book reveals the nature of local and global discourses and the lawmaking processes regarding intellectual property in Sri Lanka. While international law advocates strong standards for inventiveness in patent examination, plant breeders’ rights, and technology transfer to support high-tech development, Sri Lanka has been reluctant to implement such laws. This book is a crucial resource for researchers, policymakers, and legal professionals interested in intellectual property law, innovation ecosystems, and the socio-legal aspects of lawmaking in developing countries.

This book analyses the impact of CAFTA-DR and European Free Trade Agreements on the industrial property system in Central America. While there is ample literature on bilateral and regional FTAs, it is often limited to the contractual obligations assumed by the participating countries. This book goes a step further and analyses how these obligations are implemented through national legislation, institutional changes and legal practice. To provide a deeper understanding of the effects of FTAs on national IP systems, the book addresses research questions that go beyond general publications on the topic. Research questions include: Is the combination of market access and IP rules in a bilateral FTA an effective and appropriate trade deal? How are the IP requirements under the FTAs implemented into the national statutory framework? Do the IP rules of FTAs sufficiently address institutional factors necessary for an effective IP system? Do they provide for an appropriate balance between minimum protection and flexibilities and support relevant IP policy objectives? The book covers the CAFTA-DR member states Costa Rica, the Dominican Republic, El Salvador, Guatemala, Honduras and Nicaragua, reviewing the implementation of FTA obligations regarding patents, plant varieties, test data, trademarks, geographical indications, designs, genetic resources and traditional knowledge, enforcement and other areas. By looking at several countries, a broad range of IP rights and the practical implementation of FTA obligations, this book provides a broad range of information and insights.

Technology is key to the development of nations yet is not freely or easily accessible. This book aims to contribute to the debate about empowering Africa to play a more meaningful role in the global innovation system. It emphasizes the important role of technology transfer in assisting Least Developed Countries (LDCs) in Africa to expand their technological capabilities. The book surveys IP and innovation policies in Africa's past and present, providing theoretical, policy, and legal frameworks, as well as specific measures that will help African LDCs. It proposes solutions to overcome challenges currently posed by inefficiencies in the flow of technologies to LDCs and by the fragmentation of the international legal framework that regulates technology transfer. Notably, the book proposes maximal implementation of the TRIPS Agreement provisions related to technology transfer and recommends the adoption of a uniform international legal instrument under the framework of the WTO to be designated as the Agreement on Trade-Related Issues of Technology Transfer and Innovation (TRITTI). The book advocates for proactivity from African LDCs and urges them to cultivate environments that attract and enable technology transfer into their respective states. This will facilitate technological learning, accelerate absorption and adaptation fit to an African context, and will catapult African LDCs down the road of innovation.

This book is a reflection on domestic intellectual property lawmaking from a developing country’s perspective. It focuses on Sri Lanka—a South Asian jurisdiction with a socio-economic, cultural, and political landscape similar to other developing nations in the region, but the intellectual property regime of which has been less explored. The aim of this book is to address the discrepancies, gaps, and flaws in the national intellectual property legal framework of Sri Lanka. In doing so, the book considers Sri Lanka’s obligations under TRIPS and other related intellectual property treaties to which the country is a party. The book also examines approaches adopted by developing countries in the region and beyond, as well as other more developed nations, in calibrating Sri Lanka’s domestic intellectual property regime to better address the country’s domestic needs and national interests. The approach adopted in this book is of relevance, more generally, to policymakers, legislators, legal academics, scholars, jurists, legal practitioners and judges who are keen on exploring the extent to which domestic intellectual property legislation complies with international intellectual property norms and standards and, more importantly, the extent to which domestic law makes use of the flexibilities under international law in addressing domestic needs and national interests.

The SME Policy Index is a benchmarking tool for emerging economies to monitor and evaluate progress in policies that support small and medium-sized enterprises. The ASEAN SME Policy Index 2018 is a joint effort between the Economic Research Institute for ASEAN and East-Asia (ERIA), the Organisation for Economic Co-operation and Development (OECD) and the ASEAN Coordinating Committee on Micro, Small and Medium Enterprises (ACCMSME). The report is the outcome of work conducted by the ten ASEAN Member States (Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, the Philippines, Singapore, Thailand and Viet Nam). Divided into eight policy dimensions, it builds on the previous edition of the ASEAN SME Policy Index 2014. The current edition presents an updated methodology which makes this document a powerful tool to assess the strengths and weaknesses that exist in policy design, implementation, and monitoring and evaluation for SMEs, and allows for a benchmarking of the level to which the ASEAN Strategic Action Plan for SME Development (SAP SMED) 2016-2025 has been implemented. Its objective is to enhance the capacity of policy makers to identify policy areas for future reform, as well as implement reforms in accordance with international good practices. The report provides a regional perspective on recent developments in SME-related policies in Southeast Asia as well as in individual ASEAN Member States. Based on this analysis the report provides a menu of concrete policy options for the region and for the individual countries.

Small and medium-sized enterprises (SMEs) account for about 97–99 per cent of total enterprises and 60–80 per cent of total employment in ASEAN countries. The participation of SMEs is thus crucial for achieving greater regional economic integration amongst ASEAN countries. SMEs are, however, often constrained by many disadvantages that limit their abilities to become importers and exporters. This is well documented in the research literature on trade and firm size. This volume contains selected ASEAN country studies on the participation of SMEs in regional economic integration based on primary microdata. This is supplemented by empirical studies on the role played by East Asian multinational enterprises in the region. "The editors and authors of SMEs and Economic Integration in Southeast Asia are to be congratulated for this major contribution to the scholarly and policy literature on a subject of much public discussion but limited analytical research. The emphasis on economic integration highlights the importance of these firms in Southeast Asia’s growing regional and global engagement. The thirteen chapters, by leading authors in the field, comprise both insightful country analyses and careful examination of the links between SMEs and foreign investment." Hal Hill, H.W. Arndt Professor Emeritus of Southeast Asian Economies, Australian National University
