The Committee's report concludes that fishing stocks and the fishing industry are in crisis and significant reform of the Common Fisheries Policy (CFP) is long overdue. It welcomes the reform proposals made by the European Commission which offer the potential to make the CFP an instrument for the conservation of the marine environment and promotion of a healthy fishing industry. However, closer attention needs to be paid to the problems of industrial fishing, discarding and enforcement. Reform of the CFP will have some short and medium term costs, and the Committee supports efforts to mitigate the impact through careful choice of methods and timing of new measures, as well as the appropriate use of public aid.

The Committee's report finds that the promising reform proposals for the EU Common Fisheries Policy (CFP), recommended by the European Commission in May 2002, were seriously compromised by decisions taken by the Agriculture and Fisheries Council in December 2002, as a result of special pleading by EU Member States. Despite some positive aspects, the Committee has no confidence that the CFP regulation agreed upon will deliver sustainable fisheries management nor will it prevent the irreversible decline in key fish stocks, particularly cod and hake, unless it is substantially improved. The setting of total allowable catches (TAC) levels and EU funding for construction of new fishing vessels are also criticised. The report argues that transitional financial aid, linked to stock recovery plans, is needed to promote diversification of coastal economies and the development of alternative employment opportunities.

The Common Fisheries Policy (CFP) is one of the longest established and more controversial of the common policies of the EC. It deals principally with the management of fishery resources, relations between the EC and third States in fisheries matters, the marketing of and trade in fishery products, financial assistance to the fisheries sector, and aquaculture. However, the CFP is not just a matter for those with an economic interest in fisheries. It also raises many issues of more general concern, such as the capacity of the EC and its Member States to manage important natural resources sustainably, the impact of fishing on the wider marine environment, and relations between developed and developing States. This book addresses the CFP from a legal perspective.
