This volume examines the legacy of the International Criminal Tribunal for the former Yugoslavia (ICTY), which was created under Chapter VII of the UN Charter as a mechanism explicitly aimed at the restoration and maintenance of international peace and security. As the ICTY has now entered its twentieth year, this volume reflects on the record and practices of the Tribunal. Since it was established, it has had enormous impact on the procedural, jurisprudential and institutional development of international criminal law, as well as the international criminal justice project. This will be its international legacy, but its legacy in the region where the crimes under its jurisdiction took place is less clear; research has shown that reactions to the ICTY have been mixed among the communities most affected by its work. Bringing together a range of key thinkers in the field, Prosecuting War Crimes explores these findings and discusses why many feel that the ICTY has failed to fully engage with people’s experiences and meet their expectations. This book will be of much interest to students of war crimes, international criminal law, Central and East European politics, human rights, and peace and conflict studies.

"The drive to prosecute war crimes emerged from efforts to set rules for warfare. These agreements aim to provide protections to civilians and other noncombatants during armed conflict. They offer guidelines on how armies should conduct themselves in warfare. Most important is the rule that military forces must distinguish between enemy combatants and civilians"--

This comprehensive reference work serves as an important resource for anyone interested in the international prosecution of war crimes and how it has evolved. War Crimes and Trials analyzes the evolution of war crime trials through primary sources. Beginning with a general discussion of why regulations for war have evolved, it then illustrates the resulting changes in the nature and consequences of war as well as attitudes toward war as a part of international life. Moreover, it contextualizes contemporary rules that pertain to both international and non-international armed conflicts. The heart of the book focuses on 12 World War II cases central to the development of war law over the next 50 years, including the Nuremberg and Tokyo trials of major war criminals. It additionally dedicates discussion to the evolution of the law after World War II as set in motion by the United Nations, the 1949 Geneva Conventions and amendments, the background and operation of the ad hoc international criminal courts, and the creation of the permanent International Criminal Court, illustrating problems and successes through 12 cases drawn from these four courts.

Human Rights After Hitler written by Daniel Plesch and has been published by Georgetown University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017 with Law categories.

Human Rights after Hitler is a groundbreaking history about the forgotten work of the UN War Crimes Commission (UNWCC), which operated during and after World War II in response to Axis atrocities. He explains the commission's work, why its files were kept secret, and demonstrates how the lost precedents of the commission's indictments should introduce important new paradigms for prosecuting war crimes today. The UNWCC examined roughly 36,000 cases in Europe and Asia. Thousands of trials were carried out at the country-level, and hundreds of war criminals were convicted. This rewrites the history of human rights in the wake of World War II, which is too focused on the few trials at Nuremberg and Tokyo. Until a protracted lobbying effort by Plesch and colleagues, the UNWCC's files had been kept out of public view in the UN archives under pressure from the US government. The US initially wanted the files closed to smooth the way for post-war collaboration with Germany and Japan, and the few researchers who did gain permission to see the files were not permitted to even take notes until the files' recent release. Now revealed, the precedents set by these cases should have enormous practical utility for prosecuting war crimes today.
