Comparative law of religions has developed in recent years as a new discipline at the intersection of legal and religious science, of theology and anthropology. This book presents a systematic theoretical basis for this new discipline. While law is mostly associated with the state, many religions also have their own internal law. These internal legal norms are aimed at a particular form of behaviour on the part of believers. They therefore play a particular role in conflicts arising today between certain religious forms of behaviour. The comparison of the internal law of religions serves to establish and explain the commonalities and differences between various religious legal traditions. In Dirt for Art's Sake, Elisabeth Ladenson recounts the most visible of modern obscenity trials involving scandalous books and their authors. What, she asks, do these often-colorful legal histories have to tell us about the works themselves and about a changing cultural climate that first treated them as filth and later celebrated them as masterpieces? Ladenson's narrative starts with Madame Bovary (Flaubert was tried in France in 1857) and finishes with Fanny Hill (written in the eighteenth century, put on trial in the United States in 1966); she considers, along the way, Les Fleurs du Mal, Ulysses, The Well of Loneliness, Lady Chatterley's Lover, Tropic of Cancer, Lolita, and the works of the Marquis de Sade. Over the course of roughly a century, Ladenson finds, two ideas that had been circulating in the form of avant-garde heresy gradually became accepted as truisms, and eventually as grounds for legal defense. The first is captured in the formula "art for art's sake"-the notion that a work of art exists in a realm independent of conventional morality. The second is realism, vilified by its critics as "dirt for dirt's sake." In Ladenson's view, the truth of the matter is closer to -dirt for art's sake-"the idea that the work of art may legitimately include the representation of all aspects of life, including the unpleasant and the sordid. Ladenson also considers cinematic adaptations of these novels, among them Vincente Minnelli's Madame Bovary, Stanley Kubrick's Lolita and the 1997 remake directed by Adrian Lyne, and various attempts to translate de Sade's works and life into film, which faced similar censorship travails. Written with a keen awareness of ongoing debates about free speech, Dirt for Art's Sake traces the legal and social acceptance of controversial works with critical acumen and delightful wit.

In eighteenth-century France, censors, authors, and booksellers collaborated in making literature by navigating the intricate culture of royal privilege. Even as the king's censors outlawed works by Voltaire, Rousseau, and other celebrated Enlightenment writers, the head censor himself incubated Diderot’s great Encyclopedie by hiding the banned project’s papers in his Paris townhouse. Relationships at court trumped principle in the Old Regime. Shaken by the Sepoy uprising in 1857, the British Raj undertook a vast surveillance of every aspect of Indian life, including its literary output. Years later the outrage stirred by the British partition of Bengal led the Raj to put this knowledge to use. Seeking to suppress Indian publications that it deemed seditious, the British held hearings in which literary criticism led to prison sentences. Their efforts to meld imperial power and liberal principle fed a growing Indian opposition. In Communist East Germany, censorship was a component of the party program to engineer society. Behind the unmarked office doors of Ninety Clara-Zetkin Street in East Berlin, censors developed annual plans for literature in negotiation with high party officials and prominent writers. A system so pervasive that it lodged inside the authors’ heads as self-censorship, it left visible scars in the nation’s literature. By rooting censorship in the particulars of history, Darnton's revealing study enables us to think more clearly about efforts to control expression past and present.
