En el sector de la competencia judicial internacional, la entrada en vigor de los Reglamentos comunitarios 1347/2000 y 2201/2003 ha implicado transformaciones en el sistema a las que tendremos que añadir las que se deriven de la previsible entrada en vigor del Convenio de La Haya de 1996 en materia de protección de menores. En el ámbito del Derecho aplicable, la reforma en el año 2003 del art. 107 del C.c. ha alterado elementos de la regulación en aquellos puntos que la jurisprudencia había mostrado como problemáticos en los últimos años. Finalmente, en el sector de la eficacia extraterritorial de decisiones nos encontramos, de nuevo, con la necesidad de considerar la incidencia de los Reglamentos comunitarios 1347/2000 y 2201/2003, además de la reciente reforma de la LEC de 1881.

En este Cuaderno Jurídico abordaremos dos temas de gran importancia para la seguridad y estabilidad de los niños, niñas y adolescentes (en adelante NNA), como son la autorización de la salida de los menores del país y los aspectos civiles del secuestro internacional. Ante un mundo globalizado como el nuestro, cada vez es más frecuente que los matrimonios o los convivientes o parejas de hecho sean de diferentes nacionalidades, con lo cual el lugar donde las personas fijen su residencia pasa a ser una cuestión relevante, de manera que es necesario determinar qué sucederá con los hijos si la pareja deja de convivir o si el matrimonio termina. Estos son los diferentes problemas que llegan a los tribunales hoy día y que los jueces deben resolver con una deficiente legislación, que no es en nada adecuada a los tiempos actuales. Es difícil pensar que, a la época de entrada en vigencia del Código Civil, Andrés Bello pudiera siquiera imaginar el auge de este tipo de problemas, cada vez más frecuente por el fácil traslado de un lugar a otro, motivo por el cual no es extraño que ni siquiera haya sido tratado en nuestra legislación. En ambos temas la doctrina es escasa, por lo cual el presente trabajo versará principalmente en el análisis de sentencias de nuestros tribunales, donde se han ido fijando las interpretaciones que imperan en la práctica, teniendo en ambos temas como telón de fondo proteger el interés superior de los NNA.
