Robert G. Moeller is the first historian of modern German women to use social policy as a lens to focus on society's conceptions of gender difference and "woman's place." He investigates the social, economic, and political status of women in West Germany after World War II to reveal how the West Germans, emerging from the rubble of the Third Reich, viewed a reconsideration of gender relations as an essential part of social reconstruction. The debate over "woman's place" in the fifties was part of West Germany's confrontation with the ideological legacy of National Socialism. At the same time, the presence of the Cold War influenced all debates about women and the family. In response to the "woman question," West Germans defined the boundaries not only between women and men, but also between East and West. Moeller's study shows that public policy is a crucial arena where women's needs, capacities, and possibilities are discussed, identified, defined, and reinforced. Nowhere more explicitly than in the first decade of West Germany's history did, in Joan Scott's words, "politics construct gender and gender construct politics." Protected Children, Regulated Mothers examines child protection in Stalinist Hungary as a part of twentieth-century (East Central, Eastern, and Southeastern) European history. Across the communist bloc, the increase of residential homes was preferred to the prewar system of foster care. The study challenges the transformation of state care into a tool of totalitarian power. Rather than political repression, educators mostly faced an arsenal of problems related to social and economic transformations following the end of World War II. They continued rather than cut with earlier models of reform and reformatory education. The author’s original research based on hundreds of children’s case files and interviews with institution leaders, teachers, and people formerly in state care demonstrates that child protection was not only to influence the behavior of children but also to regulate especially lone mothers’ entrance to paid work and their sexuality. Children’s homes both reinforced and changed existing patterns of the gendered division of work. A major finding of the book is that child protection had a centuries-long common history with the “solution to the Gypsy question” rooted in efforts towards the erasure of the perceived work-shyness of “Gypsies.”

It is a commonplace that the United States lagged behind the countries of Western Europe in developing modern social policies. But, as Theda Skocpol shows in this startlingly new historical analysis, the United States actually pioneered generous social spending for many of its elderly, disabled, and dependent citizens. During the late nineteenth century, competitive party politics in American democracy led to the rapid expansion of benefits for Union Civil War veterans and their families. Some Americans hoped to expand veterans' benefits into pensions for all of the needy elderly and social insurance for workingmen and their families. But such hopes went against the logic of political reform in the Progressive Era. Generous social spending faded along with the Civil War generation. Instead, the nation nearly became a unique maternalist welfare state as the federal government and more than forty states enacted social spending, labor regulations, and health education programs to assist American mothers and children. Remarkably, as Skocpol shows, many of these policies were enacted even before American women were granted the right to vote. Banned from electoral politics, they turned their energies to creating huge, nation-spanning federations of local women's clubs, which collaborated with reform-minded professional women to spur legislative action across the country. Blending original historical research with political analysis, Skocpol shows how governmental institutions, electoral rules, political parties, and earlier public policies combined to determine both the opportunities and the limits within which social policies were devised and changed by reformers and politically active social groups over the course of the late nineteenth and early twentieth centuries. By examining afresh the institutional, cultural, and organizational forces that have shaped U.S. social policies in the past, Protecting Soldiers and Mothers challenges us to think in new ways about what might be possible in the American future.

The observation that mater semper certa est remains accurate under most legal systems in the world. Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive family law, or at least to recognize the effects of foreign law and procedures (a kind of “procreative tourism”), appear nowadays also in states generally prohibiting surrogate motherhood. The issues discussed in this volume concern both national law and international court cases. Recent examples include the opinion of the European Court of Human Rights of 10 April 2019 initiated by the French Cour de cassation, the judgement of the German Bundesgerichtshofof 20 March 2019, and dilemmas of Polish administrative courts. Focusing on the international perspective, the present volume as well as an accompanying book in Polish are the results of the international cooperation of over 30 experts from both member states and observer states of the Council of Europe. The monograph is structured “from the general to the detail” and includes a comprehensive view as well: from the issues of philosophy and sociology of law, to human rights standards of national constitutions and international agreements, to principles of ordre public of forum and their protection with measures of private, public, and penal law. This allows readers, including legislators and judges, the better understanding of the fundamental legal problems that surrogate motherhood brings, both in states where law creates them in a narrower or wider extent, and in other countries of the world, to which these problems can be imported with the movement of people and with de lege lata and de lege ferenda postulates.

The word “mother” traditionally meant a woman who bears and nurtures a child. In recent decades, changes in social norms and public policy as well as advances in reproductive technologies and the development of markets for procreation and care have radically expanded definitions of motherhood. But while maternity has become a matter of choice for more women, the freedom to make reproductive decisions is unevenly distributed. Restrictive policies, socioeconomic disadvantages, cultural mores, and discrimination force some women into motherhood and prevent others from caring for their children. Reassembling Motherhood brings together contributors from across the disciplines to consider the transformation of motherhood as both an identity and a role. It examines how the processes of bearing and rearing a child are being restructured as reproductive labor and care work change around the globe. The authors examine issues such as artificial reproductive technologies, surrogacy, fetal ultrasounds, adoption, nonparental care, and the legal status of kinship, showing how complex chains of procreation and childcare have simultaneously generated greater liberty and new forms of constraint. Emphasizing the tension between the liberalization of procreation and care on the one hand, and the limits to their democratization due to race, class, and global inequality on the other, the book highlights debates that have emerged as these multifaceted changes have led to both the fragmentation and reassembling of motherhood.
