Since the terrorist attacks of September 11, 2001, there has been much discussion of the security of borders and ports of entry in the United States and around the world. Ports of entry, particularly sea ports, are viewed as one of the most defenceless targets for a terrorist attack. In response to this perceived vulnerability, a number of port security initiatives have been implemented both on both a domestic and international level. This timely project investigates a number of issues surrounding the container security issue. It examines the scope of containerized freight security, analyzes cooperation between agents in the United States and abroad, explores the politics of port security, and provides an assessment of 17 of the world's sea ports. The work sheds light on the container security threat and the domestic and international responses that have emerged, as well as those steps that still must be taken.

This is the first book to offer a comprehensive overview of modern seaports from a legal perspective. Further, it provides a basic toolkit for establishing a legal doctrine of seaports, the instruments of said toolkit being the very few legal norms specifically targeting seaports, which are examined as such rather than through the lens of other, more established disciplines, such as the law of the sea or transportation law. It is a first, necessary step toward giving seaports the status they rightfully deserve in legal studies. Despite centuries of international law studies and decades of EU law evolution, seaports have remained stuck in limbo. From a law of the sea perspective, seaports belong to the land, an approach that is often clearly reflected in national maritime legislation. The other branches of international law do not focus on seaports, since they are considered to belong to the sea. The port communities, for their part, have availed themselves of the “port specificity” concept. In recent decades, containerization has transformed ports into key hubs of the globalized economy, but also into vital checkpoints of the War on Terror, due to the security risks posed by the millions of sealed containers circulating worldwide. Moreover, tragic maritime incidents have shown that seaports are the only reliable sentinels of the seas, being the only places where the systematic inspection of ships is feasible. This has led to the adoption of specific international and EU rules. Those rules, however, remain fragmented, highly specialized and technical; as such, they are unsuitable for creating an organic legal seaport regime: this objective can only be achieved with a significant contribution from legal doctrine.

An Advanced Research Workshop (ARW) “Data Fusion Technologies for Harbour Protection” was held in Tallinn, Estonia 27 June–1 July, 2005. This workshop was organized by request of the NATO Security Through Science Programme and the Defence Investment Division. An ARW is one of many types of funded group support mechanisms established by the NATO Science Committee to contribute to the critical assessment of existing knowledge on new important topics, to identify directions for future research, and to promote close working relationships between scientists from different countries and with different professional experiences. The NATO Science Committee was approved at a meeting of the Heads of Government of the Alliance in December 1957, subsequent to the 1956 recommendation of “Three Wise Men” – Foreign Ministers Lange (Norway), Martino (Italy) and Pearson (Canada) on Non-Military Cooperation in NATO. The NATO Science Committee established the NATO Science Programme in 1958 to encourage and support scientific collaboration between individual scientists and to foster scientific development in its member states. In 1999, following the end of the Cold War, the Science Programme was transformed so that support is now devoted to collaboration between Partner-country and NATO-country scientists or to contributing towards research support in Partner countries. Since 2004, the Science Programme was further modified to focus exclusively on NATO Priority Research Topics (i. e. Defence Against Terrorism or Countering Other Threats to Security) and also preferably on a Partner country priority area.

To mitigate the risks posed by microbial threats of public health significance originating abroad, the Centers for Disease Control and Prevention (CDC) places small groups of staff at major U.S. airports. These staff, their offices, and their patient isolation rooms constitute quarantine stations, which are run by CDC's Division of Global Migration and Quarantine (DGMQ). Congress began to allocate funds in fiscal 2003 for the establishment of new quarantine stations at 17 major U.S. ports of entry that comprise airports, seaports, and land-border crossings. In a significant departure from the recent past, both the preexisting 8 quarantine stations and the new 17 are expected to play an active, anticipatory role in nationwide biosurveillance. Consequently, DGMQ asked the Institute of Medicine (IOM) to convene an expert committee to assess the present CDC quarantine stations and recommend how they should evolve to meet the challenges posed by microbial threats at the nation's gateways. DGMQ specifically requested "an assessment of the role of the federal quarantine stations, given the changes in the global environment including large increases in international travel, threats posed by bioterrorism and emerging infections, and the movement of animals and cargo." To conduct this assessment and provide recommendations, IOM convened, in October 2004, the Committee on Measures to Enhance the Effectiveness of the CDC Quarantine Station Expansion Plan for U.S. Ports of Entry. At the sponsor's request, the committee released the interim letter report Human Resources at U.S. Ports of Entry to Protect the Public's Health in January 2005 to provide preliminary suggestions for the priority functions of a modern quarantine station, the competences necessary to carry out those functions, and the types of health professionals who have the requisite competences (Appendix A). This, the committee's final report, assesses the present role of the CDC quarantine stations and articulates a vision of their future role as a public health intervention.
