A interlocução entre psicanálise e direito é bem mais rica e complexa do que se imagina quando colocamos em foco os discursos e as práticas de encontro entre ambos os domínios. Muito mais do que uma sobreposição simples, tais campos de saber se desafiam numa tensão permanente que denuncia alguns hiatos intransponíveis. O que não torna a interlocução inviável, ao contrário, só a torna mais interessante e produtiva. Nesse (des)encontro entre psicanálise e direito, esperamos que alguns conceitos fundamentais da psicanálise sejam exportados para a área jurídica e promovam questionamentos capazes de revirar noções estabelecidas sobre sujeito, razão, verdade, bem e mal que frequentemente pautam decisões judiciais e até mesmo certas legislações. Ao promover tal subversão a partir da psicanálise, ingressamos numa dimensão ética na qual incluímos o desejo e, por consequência, a falta, na motivação legitima do agir. Os artigos que compõem esta coletânea seguem essa marca de caráter eminentemente ético. Passando por temas intrincados, da proteção da infância ao adolescente em conflito com as leis, das perícias em Varas de Família e de Violência doméstica ao paciente judiciário, do abuso e da violência sexual à alienação parental, da homofobia a temas ainda mais amplos, como o estado de exceção e os discursos de ódio, os autores subvertem conceitos e perspectivas assentadas no campo do direitos e promovem novos sentidos que, em última instância, visam modificar o laço social de tal maneira que dê suporte ao sujeito em sua radical singularidade.

Em tempos nos quais a adolescência é cultuada com a imagem da eterna juventude, do descompromisso e da beleza fugaz, surge, na contramão dessa perspectiva hedonista, a figura do Mal, associada à juventude em crise, transviada, desvairada, vândala, violenta. Imagens que unificam diferenças irredutíveis entre cada adolescente na experiência da travessia para a vida adulta. A adolescência não é um conceito, nem uma fase, ela é uma construção histórica, variável culturalmente, criada para tratar de um dos maiores embaraços da vida do ser falante: a sexualidade (Freud, 1905). Assim, se, por um lado, a adolescência nomeia o encontro com a dimensão traumática, porque inapreensível pela linguagem, do sexual (Lacan, 1974); por outro, ela assinala a passagem de um ser cuidado pelo outro para um sujeito autônomo e produtivo. Ela desenha e testemunha outro encontro, também difícil, do adolescente com o campo social e toda sua estrutura econômica, social e política que ganha, discursivamente na atualidade, o desejo de dominação na forma objetiva do consumismo, das estatísticas, do cientificismo e da segregação. Quando o estado de exceção se torna a regra e as soluções de emergência, a rotina, como nos adverte Agamben (2008), deparamo-nos com nova impossibilidade: a do corpo ser totalmente recoberto pela política na cena da cidade. Diante desses dois impossíveis, o sexual e o político, na experiência da adolescência em conflito com a lei, colocamos a Psicanálise em sua interface com o Direito, a trabalho neste livro. Discutindo especialmente a temática da infração, optamos por tomar em análise não apenas a perspectiva do jovem, mas implicar todo o sistema de dispositivos, constituído em seu entorno, para pensar suas possibilidades de construção de novos projetos de vida.
