Hipnoterapis dalam menjalankan tugas profesinya seharusnya disesuaikan dengan batas-batas yang telah ditentukan agar dapat dituntut atau digugat karena telah bertindak yang di nilai telah merugikan masyarakat. Namun pada kenyataannya, hipnoterapis sebagai profesi belum ada Undang-Undang yang mengatur sehingga ketika ada kelalaian dan kesengajaan, maka masuk dalam delik pidana dan dapat dihukum sesuai dengan perbuatannya yang melanggar kesusilaan. Dalam hal ini, dipastikan bahwa seseorang yang sehat secara jiwa dapat dimintai pertanggung jawaban pidana seadil-adilnya dan untuk itu dikenakan sanksi yang sepadan dengan kesalahannya itu.
