Psychological jurisprudence—or the use of psychology in the legal realm—relies on theories and methods of criminal justice and mental health to make decisions about intervention, policy, and programming. While the intentions behind the law-psychology field are humane, the results often are not. This book provides a "radical" agenda for psychological jurisprudence, one that relies on the insights of literary criticism, psychoanalysis, feminist theory, political economy analysis, postmodernism, and related strains of critical thought. Contributors reveal the roots of psycholegal logic and demonstrate how citizen justice and structural reform are displaced by so-called science and facts. A number of complex issues in the law-psychology field are addressed, including forensic mental health decision-making, parricide, competency to stand trial, adolescent identity development, penal punitiveness, and offender rehabilitation. In exploring how the current resolution to these and related controversies fail to promote the dignity or empowerment of persons with mental illness, this book suggests how the law-psychology field can meaningfully contribute to advancing the goals of justice and humanism in psycholegal theory, research, and policy.

This volume presents a Type Theory of Law (TTL), claiming that this is a unique theory of law that stems from the philosophical understanding of Jung’s psychological types applied to the phenomenon of law. Furthermore, the TTL claims to be a universal, general and descriptive account of law. To prove that, the book first presents the fundamentals of Jungian psychological types, as they had been invented by Jung and consequently developed further by his followers. The next part of the book describes how the typological structure of an individual determines their understanding of law. It then addresses the way in which inclusive legal theory can be understood based on this typology. Finally, the book describes the TTL in general and descriptive terms and puts it into context. All in all, the book shows how the integral or inclusive approach to understanding the nature of law is not only in tune with our time, but also relevant for presenting a more persuasive picture of law than the older exclusivist or dualist approaches of strict natural law and rigid legal positivism did.

Excerpt: ...to which the expression 'implied contract' has been used to denote not only a genuine contract established by inference, but also an obligation which does not arise from any real contract, but which can be enforced as if it had a contractual origin. Obligations of this class are called by civilians ' obligationes quasi ex contractu ' " It appears to have been assumed that the rule that a lunatic cannot enter into a contract admitted of an exception in the case of necessaries: whereas, in fact, the law does not admit of an exception, but, in recognition of the fact that a lunatic himself cannot enter into a contract, it will raise a quasi contract or obligation for him on one of two assumptions, viz., (I) that, if the lunatic were in possession of his senses, he would be willing to pay the cost of necessaries supplied for his use; (2) that, inasmuch as only necessaries have been supplied to the lunatic, it is equitable that he or his estate should bear the cost thereof. The ratio deeidendi in the cases cited above appears to have been based on the mere fact that a lunatic is incapable of coming to tha't consensus ad idem without which no contract can be formed. If this be the law as to necessaries, it applies with even greater force to contracts alleged to have been entered into by a lunatic for purposes other than the supply of necessaries. In other words, inasmuch as the law deems a lunatic incapable of contracting even for necessaries, and, accordingly, raises an obligation for him; it would seem to follow, a fortiori, that in the case of goods or services which are not necessaries a lunatic is incapable of binding himself by contract.
