The deep-seated problems within the pub industry and in particular the relationship between pub companies and their lessees, who run pubs, have been the subject of repeated scrutiny by Parliamentary select committees. Earlier reports on this subject having been published as HC 128-I & II, session 2004-5 (ISBNs 9780215021007, 9780215022653), HC 434, session 2004--05 (ISBN 9780215022868), HC 503, session 2009-10 (ISBN 9780215545510), HC 138, session 2009-10 (ISBN 9780215544377) ; and HC 26-I, session 2008-09 (ISBN 9780215530127). Each Committee report challenged the industry to deliver meaningful reform and on every occasion the industry was found wanting. The latest follow-up, HC 138 of session 2009-10 delivered a final ultimatum to the industry. It was stated that if the Business Innovation and Skills Committee concludes by then that the Code is not working as well as it should be it would consult on putting the Code on a statutory basis with effective enforcement. The present Government has confirmed that it would continue that policy. This report is an assessment of the recommendations made by the committee and what the response has been from the industry. The committee concludes that 'it is now time for the Government to act on its undertaking' and cautions the Government that offering a compromise of non-statutory intervention would be a departure from its undertaking and would not bring about meaningful reform that is needed

Tony Thornton looks at community ownership as a vehicle for saving pubs, along with its flaws, and examines the critical role of CAMRA. Returning to the overall market, the book focuses on the battles between the Regional brewers for survival and why these took place. It explains how the hedonism of the Nineties suddenly ended in the new millennium and why the high street operators faced their own crisis, which then merged with that of the retail industry. It also examines how the politicians have frequently misjudged pubs and the beer industry and done it few favours – and how the industry is still paying the price for their decisions. Equally controversially, it discusses why the Beer Tie, the glue that holds the industry together, is threatened if the Government introduces a Statutory Code. Moving to the present, the book considers the effects of the renaissance in brewing, the changes to food-led pubs and debates the impact of Craft beer. It looks at how pubs have changed because of the influence of food. Most crucially it concludes with the plight of the traditional, drinkers pub and looks for positive signs and trends for the future.

The Committee's inquiry into the relationship between pub companies (pubcos) and their tenants has been prompted by a request from the Federation of Small Businesses, which was concerned about the degree to which public house ownership was being concentrated in a small number of companies. Issues discussed in the report include: developments in the UK beer market during 1989 to 2004; EU investigations; the impact of pubcos on the sale and distribution of beer; the contractual relationship between tenant and pubco; the benefits and costs of the exclusive purchasing obligation (beer tie) required by pubcos of their tenants; and the basis on which public house rents are calculated. Many pubcos have adopted voluntary codes of practice which incorporate guidance from the British Beer & Pub Association on the granting and operation of leases. The code of practice should cover areas such as rent reviews; the role of business development managers; complaint and dispute procedures; disclosure and the availability of information; and the taking of legal and professional advice by prospective tenants. The Committee concludes that a legally binding code of practice is unnecessary at this stage, but that the Government may need to impose a statutory code if the industry does not show signs of accepting and complying with an adequate voluntary code of best practice.
