This book deals with what the author considers a sorely neglected question, namely the role of the judiciary in states’ foreign policy processes. Dr. Riaan Eksteen is a Former South African Ambassador residing in Namibia; from 1968-1973 he served at the South African Embassy in Washington D.C.; between 1976-1994, he subsequently served as Ambassador and Head of Mission at the U.N. in New York (1976-81), in Namibia (1990-91), at the U.N. in Geneva (1992-94), and in Turkey, with accreditation also to Azerbaijan, Kyrgyzstan, Turkmenistan and Uzbekistan (1995-97). He obtained his Ph.D. from the University of Johannesburg in October 2018.

A thorough reassessment of how domestic factors do and do not constrain the use of American military force abroad in the early twenty-first century. More than two decades have passed since the September 11th terrorist attacks resuscitated debates about the “imperial presidency” within the United States. During that same time, the United States has fought costly and inconclusive wars in Iraq and Afghanistan, pivoted to the Pacific to counter China, and pulled its gaze back to Europe and the Middle East in response to wars in Ukraine and Gaza. Moreover, new technologies and ways of funding and staffing wars have made the costs of war less visible to the public while polarization has increased and a new legal doctrine of presidential power has gained force. War has been an ever-present feature of human existence. The analysis of wars has tended to focus on either their causes or the military and strategic consequences of a conflict. This book argues that war can have a much wider impact across layers of society that go beyond international boundaries. It presents a heuristic multi-disciplinary framework for analysing the ripple and backwash effects across five connected analytical layers around the world: material; human capabilities; economic; values belief and attitudes; policy and governance; and power.
