Owing to its massive state sector, public procurement in China is a critical element of public policy. At the same time, because of its considerable market size, public procurement is of increasing importance for international trade, and thus subject to enacted regulations in most countries and has been put on the agenda of international and regional trade organisations, such as the WTO. This book examines China’s public procurement regime since the launching of market-oriented reform in 1978. It outlines the development of the relevant national laws and their implementing regulations, which have evolved from scratch since the onset of economic reform. It considers the impact of WTO membership, and the steps China has taken to initiate negotiations on accession to the WTO Government Procurement Agreement (GPA) by the end of 2007. It also provides a detailed picture of the current legal framework, assessing the impact of key legislative measures including the Tendering Lawof 2000 and the Government Procurement Lawof 2003. The decision not to launch negotiations in the World Trade Organization (WTO) on three of the Singapore Issues in the so-called July 2004 package provides an opportunity to revisit the knowledge base on which proposals for further international collective action may be drawn. This paper examines the available evidence on public procurement practices in developing countries that could be relevant to further multilateral rule making on state purchasing. Although there is considerable agreement on ends (efficient, non-corrupt, and transparent public purchasing systems), little information is available on means and, in particular, on the effective and replicable strategies that developing countries can adopt to improve their public procurement systems. A concerted effort to substantially add to the knowledge base on public procurement reforms in developing countries, through targeted research and international exchange of information on implemented procurement policies and outcomes, is critical to identifying areas where further binding multilateral disciplines may be beneficial.

In this paper, we argue that there is much room for China to strengthen its regulatory framework for public-private partnerships (PPPs). We show that infrastructure projects carried out through local government financing vehicles (LGFVs) were largely unregulated PPPs, and significant fiscal risks have already manifested themselves. While PPPs can potentially provide efficiency gains, they can also be used by governments to circumvent budgetary borrowing constraints. Therefore, effective PPP regulation is key to delivering PPPs’ benefits while containing their potential fiscal risks. The authorities have taken concrete steps in order to establish a sound regulatory framework and foster a new generation of PPPs. However, to make the framework effective, we highlight a few issues to be resolved. Based on international best practice, we propose a four-pillar regulatory framework for China, which could be implemented gradually in three stages.
