La constitutionnalisation du droit pénal désigne l'emprise croissante de la Constitution sur la matière pénale du fait de l'enrichissement des principes constitutionnels et de la diversification des contrôles de constitutionnalité. Le Conseil constitutionnel n'est pas le seul acteur à l'origine de ce processus. Celui-ci est, en effet, porté par toutes les autorités de contrôle, de conception et d'application du droit pénal qui contribuent ensemble, par le partage de leurs compétences et l'échange de leurs doctrines, à l'existence d'un droit pénal conforme à la Constitution et à la construction du volet pénal de la norme suprême. Quant à son objet, la constitutionnalisation est porteuse de légitimation pour le droit pénal : la consécration et le respect de principes supérieurs d'inspiration humaniste ont vocation à susciter l'adhésion du justiciable, amené à percevoir le droit pénal comme juste et justifié. Si la constitutionnalisation présente encore de nombreuses faiblesses, son impact sur le droit pénal est considérable puisqu'elle transforme en profondeur la matière tant d'un point de vue institutionnel que d'un point de vue substantiel. Il en résulte que la constitutionnalisation marque le passage d'un droit pénal légal soumis à la Constitution à un droit pénal constitutionnel, c'est-à-dire un droit pénal sans cesse rapproché de la Constitution et enrichi de sources diverses et de principes supérieurs garants de sa légitimité.
