La actividad de regulación ejercida por la Comisión de Regulación de Comunicaciones (CRC), desde su génesis, presenta falencias en lo que a autonomía estatutaria e independencia funcional se refiere; si bien desde su creación se ha propendido a mejorarla cada vez más, hoy continúan vigentes sus principales problemas. Lo anterior, en razón a su encuadramiento como unidad administrativa especial, su pertenencia a la Administración Pública, así como a la composición y elección de sus miembros. Así las cosas, esta obra centra sus esfuerzos en identificar y analizar las problemáticas que enfrenta la estructura organizativa de la CRC dentro de la administración pública, que le impiden ejercer sus funciones de regulador de forma óptima, independiente y autónoma. Luego, de forma propositiva, se exponen posibles soluciones para intentar conjurar las problemáticas identificadas que, grosso modo, se resumen en la reorganización de la CRC dentro de otra de las figuras de derecho administrativo, cual es la agencia, con un contenido normativo nuevo y reformando la composición, mecanismos de elección y periodos de los comisiona-dos. Concluida la proposición, el lector poseerá un estudio minucioso y prolijo que da lugar a propuestas que podrían llegar a ser implementadas en la Administración Pública de Colombia, para lograr que el regulador de comunicaciones desempeñe sus competencias de una mejor manera. Aunque la literatura publica se ha encargado de forma vasta de analizar las problemáticas de la CRC y, en algunos estudios, de proponer soluciones, la novedad que trae este libro es que el análisis parte de la nueva Ley 1978 de 2019 que modificó la estructura y funciones del regulador de las comunicaciones.

In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.
