Improving Regulation written by Paul S. Professor Fischbeck and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2001-08-21 with Business & Economics categories.

Is there potential for a U.S. regulatory system that is more efficient and effective? Or is the future likely to involve 'paralysis by analysis'? Improving Regulation considers the challenges faced by the regulatory system as society and technology change, and our knowledge about the effects of our activities on human and planetary health becomes more sophisticated. While considering the difficulty in linking regulatory design and performance, Improving Regulation makes the case for empowering regulatory analysis. Studying applications as diverse as fire protection, air and water pollution, and genetics, its contributors examine the strategies of different stakeholders in today's complex policymaking environment. With a focus on the behavior of institutions and people, they consider the impact that organizational politics, science, technology, and performance have on regulation. They explore the role of technology in creating and reducing uncertainty, the costs of control, the potential involvement of previously unregulated sectors, and the contentious public debates about fairness and participation in regulatory policy. Arguing that the success of many regulations depends upon their acceptance by the public, Fischbeck, Farrow, and their contributors offer extensive, inductive evidence on the art of regulatory analysis. The resulting book provides 'real world' examples of regulation, and a demonstration of how to synthesize analytical skills with a knowledge of physical and social processes.

This report documents a newly developed model of the incentives for private investment in new technology, and shows how the model can be used to examine the effects of existing-product regulations on technological change. The report uses the chlorofluorocarbon emissions regulatory scenario as a reference case for exploring the ways in which RAND's R & D model can be used to evaluate alternative forms of regulation. The model is developed in Sec. II, and some extensions are considered in Sec. III. The model offers insights beyond those strictly related to the regulations under investigation. The regulations discussed in Sec. IV--mandatory controls, excise taxes, and production quotas--are widely recognized alternatives for controlling environmental hazards. Section V shows how to use the analytic results to evaluate regulatory effects on several key classes of innovations, including the development of nonregulated products. Finally, Sec. VI summarizes the findings and discusses their implications for welfare analysis.

This anthology discusses important issues surrounding environmental law and economics and provides an in-depth analysis of its use in legislation, regulation and legal adjudication from a neoclassical and behavioural law and economics perspective. Environmental issues raise a vast range of legal questions: to what extent is it justifiable to rely on markets and continued technological innovation, especially as it relates to present exploitation of scarce resources? Or is it necessary for the state to intervene? Regulatory instruments are available to create and maintain a more sustainable society: command and control regulations, restraints, Pigovian taxes, emission certificates, nudging policies, etc. If regulation in a certain legal field is necessary, which policies and methods will most effectively spur sustainable consumption and production in order to protect the environment while mitigating any potential negative impact on economic development? Since the related problems are often caused by scarcity of resources, economic analysis of law can offer remarkable insights for their resolution. Part I underlines the foundations of environmental law and economics. Part II analyses the effectiveness of economic instruments and regulations in environmental law. Part III is dedicated to the problems of climate change. Finally, Part IV focuses on tort and criminal law. The twenty-one chapters in this volume deliver insights into the multifaceted debate surrounding the use of economic instruments in environmental regulation in Europe.

The Rules Of Federalism written by R. Daniel. KELEMEN and has been published by Harvard University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-06-30 with Business & Economics categories.

This book examines patterns of environmental regulation in the European Union and four federal polities--the United States, Germany, Australia, and Canada. Daniel Kelemen develops a theory of regulatory federalism based on his comparative study, arguing that the greater the fragmentation of power at the federal level, the less discretion is allotted to component states. Kelemen's analysis offers a novel perspective on the EU and demonstrates that the EU already acts as a federal polity in the regulatory arena. In The Rules of Federalism, Kelemen shows that both the structure of the EU's institutions and the control these institutions exert over member states closely resemble the American federal system, with its separation of powers, large number of veto points, and highly detailed, judicially enforceable legislation. In the EU, as in the United States, a high degree of fragmentation in the central government yields a low degree of discretion for member states when it comes to implementing regulatory statutes. Table of Contents: Acknowledgments 1. Regulatory Federalism and the EU 2. Environmental Regulation in the EU 3. Environmental Regulation in the United States 4. Environmental Regulation in Germany 5. Environmental Regulation in Australia and Canada 6. Food and Drug Safety Regulation in the EU 7. Institutional Structure and Regulatory Style Notes References Cases Cited Index R. Daniel Kelemen's The Rules of Federalism is an important contribution to both the literature on federalism and on the European Union. It makes an original theoretical and empirical contribution to our understanding of regulatory federalism and sheds new light on the federal systems which it compares. It will open up new avenues of inquiry. --Alberta Sbragia, University of Pittsburgh The Rules of Federalism makes a significant contribution to the literature on regulatory federalism. Keleman's original theoretical perspective is made plausible through a series of fascinating case studies. The book will be of interest to scholars of federalism, constitutional design, environmental policy, and the European Union. --Susan Rose-Ackerman, Yale Law School

European Environmental Law written by John R. Salter and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 1994-09-01 with Science categories.

The rapid rate of regulation and the wide spectrum of activities and substances now falling under environmental control necessitate a succinct, accurate, and up-to-date text on current European environmental law for legal practitioners and other professionals inside and outside Europe. This work fills that requirement, tempering theoretical discussion with the pressing need of the practitioner to know the state of the law and its application. Three main sections, entitles The European Natural, Humand and Man-Made Environments, accessibly set out the black letter law on an extremely wide range of matters. Introductions to each section provide capsule overviews of the material. An exhaustive subject index furthers the usefulness of the text as a broad practical resource. This work includes coverage of developments in the effectuation of European environmental law; cases decided by the European Court of Justice and other European courts issuing relevant decisions (such as the European Court of Human Rights); and refence to community legislation (treaty texts and consolidated table of enacted and proposed secondary EC legislation).
