This is the first comprehensive socio-legal study of the interrelation between gender and the law of refugee status. In the past decade, the issue has received increasing attention in academic writing, the media and the courtroom. This book contains an interdisciplinary analysis. The empirical data, collected for this study and not published previously, concerns Dutch asylum practice. The Netherlands is a prominent refugee-receiving country in Europe, yet hardly any English texts address Dutch refugee law. The book also covers foreign case law and academic writing. Therefore, the analysis is relevant for all refugee-receiving countries in the Western world; the empirical data on The Netherlands functions as a case study. The book combines perspectives of post-structuralist feminism and post-colonial studies. Refugee women are constructed as a double other. The book provides a comprehensive overview of academic writing and of case law on the subject. This work deals with the temporal effect of judicial decisions and more specifically, with the hardship caused by the retroactive operation of overruling decisions. By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled by the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions.

J.C. Baud was de langst dienende minister onder koning Willem II (1840-1849). Hij stond aan het hoofd van het Departement van Koloniën, dat van cruciale betekenis was voor het herstel van de overheidsfinanciën. Het was de tijd waarin de Nederlandse staat nagenoeg bankroet was en slechts op de been werd gehouden door de koloniale baten die op Java met het Cultuurstelsel werden verkregen. Kort na de troonsbestijging van Willem II begon Baud aantekening te houden van de wekelijkse gesprekken die hij met de koning voerde over het koloniale beleid en ook over de binnenlandse politiek, in het bijzonder de herziening van de grondwet. Baud heeft deze aantekeningen tot het einde van zijn ministerschap volgehouden. Zo ontstond een uniek document dat nagenoeg het hele koningschap van Willem II beslaat, namelijk de periode van januari 1841 tot maart 1848. De vijf kleine boekjes waarin Baud zijn aantekeningen maakte, zijn altijd in familiebezit gebleven en hebben daar decennia lang een onzichtbaar bestaan geleid. Door het vaak onleesbare handschrift was het niet eenvoudig om de aantekeningen op juiste waarde te schatten. Systematische studie met aanvullende toelichting heeft van een reeks fragmentarische notities een spannend politiek verhaal gemaakt. Dit boek werpt niet alleen een nieuw licht op het omstreden koningschap van Willem II, maar gunt de lezer ook een blik in het politieke besluitvormingproces gedurende een periode waarin nog geen sprake was van volledige ministeriële verantwoordelijkheid. Why do judges study legal sources that originated outside their own national legal system, and how do they use arguments from these sources in deciding domestic cases? Based on interviews with judges, this book presents the inside story of how judges engage with international and comparative law in the highest courts of the United Kingdom, Canada, the United States, France and the Netherlands. A comparative analysis of the views and experiences of the judges clarifies how the decision-making of these Western courts has developed in light of the internationalisation of law and the increased opportunities for transnational judicial communication. While the qualitative analysis reveals the motives that judges claim for using foreign law and the influence of 'globalist' and 'localist' approaches to judging, the author also finds suggestions of a convergence of practices between the courts that are the subject of this study. This empirical analysis is complemented by a constitutional-theoretical inquiry into the procedural and substantive factors of legal evolution, which enable or constrain the development and possible convergence of highest courts' practices. The two strands of the analysis are connected in a final contextual reflection on the future development of the role of Western highest courts.
