Apesar da pós-modernidade, o texto de Hegel sobre a Razão e a Política conserva uma surpreendente possibilidade de atualização. Isso se explica a partir do fato de que, mesmo à luz do caráter “idealista absoluto” e epocal do sistema de seu pensamento, Hegel é um pensador profundamente realista e, dentro de seus limites, alguém que procurou metafisicamente levar a sério o seu tempo. É nesse sentido que o filósofo afirma a impossibilidade de o pensamento ultrapassar o seu tempo, bem como a inutilidade de tentar adivinhar o futuro, apesar de podermos compreender algumas tendências e propensões. Assim, pensar hoje a compreensão hegeliana do político é um desafio fecundo. Convicto de estarmos inseridos na tradição do pensamento ocidental que tem seu germe nos gregos e seu resultado mais elaborado em Hegel, o autor analisa nesta obra a filosofia política de Hegel à luz de sua filosofia total e estabelece em que sentido a filosofia política hegeliana pode apresentar-se a si mesma como saber absoluto e definitivo do Estado. Ao mesmo tempo, reafirma a relatividade de toda filosofia política, uma vez que só pode dizer a política do tempo por vir a partir do interior de seu próprio tempo. Trata-se de uma filosofia da filosofia política.

Publicado originalmente em 1843, a Crítica da filosofia do direito de Hegel é um divisor de águas na obra marxiana: marca a transição da chamada fase "juvenil" para a fase adulta e a consolidação dos pressupostos que irão orientar a produção do seu pensamento até sua maturidade. Ao investigar Hegel, Marx associaria definitivamente a compreensão das relações jurídicas na sociedade com as suas condições materiais; o pensar em função do ser e a alienação do povo; o "Estado real" em relação ao Estado moderno que o segrega e o burocratiza na qualidade de "sociedade civil". O autor também repensa o papel da teoria crítica, estabelecendo que esta não se completa apenas no campo teórico das filosofias da religião e da ciência, mas tem um indispensável campo prático na política. Se por um lado visava superar os fundamentos estabelecidos por Hegel para o Estado alemão, por outro visava, através da associação entre a reflexão e a prática, ir além do trabalho teórico de crítica da religião de Feuerbach, uma forte influência neste trabalho. Marx provoca um salto sobre os debates da época em torno da obra de Hegel, para uma visão mais ampla dos fundamentos do direito na Alemanha, seu anacronismo que não permite concessões, suas relações com as classes sociais e com o estágio de desenvolvimento nacional. Uma defesa radical da verdadeira democracia, da máxima generalização do Estado, com a participação de cada cidadão para superar a divisão entre política e sociedade.

O artigo de Hegel Sobre as maneiras científicas de tratar o Direito Natural crítica as formas correntes de abordagens do Direito Natural. Nem o jusnaturalismo empírico, nem o jusnaturalismo transcendental kantiano perceberam a natureza orgânica da vida política, impedindo assim a compreensão do fundamento ético do Direito. O projeto jurídico hegeliano é o de um Direito especulativo, ou seja, um Direito de natureza ética. Aqui, a suprassunção das contradições concretiza-se no momento especulativo, isto é, na identidade da identidade e da diferença. Este projeto será, de fato, desenvolvido ao longo da trajetória filosófica hegeliana, consolidando-se, posteriormente, em todos os momentos sua obra sistemática. A Filosofia do Direito hegeliana, sem dúvida, não legitima um paradigma jurídico-filosófico que garanta apenas os direitos individuais atomizados. Ao contrário, ela já antecipa a matriz filosófica da intersubjetividade, ao propor um direito de natureza ético-orgânica.

Associando-se a um amplo movimento comemorativo europeu e norte-americano, o Instituto de Estudos Filosóficos, com sede na Faculdade de Letras da Universidade de Coimbra, em colaboração com a unidade de I&D L.I.F. – Linguagem, Interpretação e Filosofia e com o “Centro de Filosofia” da Universidade de Lisboa organizou nos dias 19 e 20 de Novembro de 2007 um Congresso Internacional comemorativo dos 200 anos da Fenomenologia do Espírito de G. W. F. Hegel, obra publicada inicialmente em 1807. Por ocasião deste congresso, a comunidade filosófica portuguesa teve a grata oportunidade de se confrontar com algumas das mais recentes orientações de análise da obra do filósofo, pondo-se a si mesma à prova quanto às suas aptidões analíticas. Aqui se deixa o retrato de um tal encontro, tanto quanto possível fiel ao que foram, na altura, as exposições dos diferentes autores. In conjunction with a broad commemorative movement in Europe and America, the Institute for Philosophical Studies, based at the Faculty of Letters, University of Coimbra, in collaboration with the R&D unit L.I.F. – Language, Interpretation and Philosophy and with the “Centre for Philosophy” of the University of Lisbon organized on 19th and 20th November 2007 an international conference commemorating the 200th anniversary of Hegel’s Phenomenology of Spirit (first published in 1807). On the occasion of this conference, the Portuguese philosophical community had the opportunity to come up against some of the most recent orientation in the analysis of this philosopher’s oeuvre, putting itself to the test as regards its analytical skills. This volume offers a picture of that encounter, as faithful as possible to what were, at the time, the papers offered by/expositions of the various authors.
