Début 2005, quelque 260 radios privées émettent en Afrique centrale (Burundi, Cameroun, Congo, Gabon, Rca, Rdc, Rwanda et Tchad) vers des publics urbains et ruraux, proposant des programmes de divertissement, d'éducation citoyenne, d'évangélisation, ou de l'information de proximité. Tous les pays de la région disposent désormais d'une législation reconnaissant et organisant le pluralisme radiophonique, à l'exception toutefois de la Guinée équatoriale. Cette évolution majeure du secteur de la radio-diffusion en Afrique centrale - en moins de cinq années -a amené l'Institut Panos Paris à entreprendre un diagnostic de son environnement juridique. Quelles sont les conditions législatives et réglementaires d'exploitation des stations de radio-diffusion privées et publiques ? Comment les fréquences d'émission sont-elles attribuées, pour quelle durée, à quels coûts, par qui et à quelles conditions ? Les instances de régulation ont-elles veillé à adopter des réglementations adaptées à la spécificité des radios commerciales, associatives, confessionnelles, communautaires ? Telles sont quelques-unes des questions fondamentales qui ont guidé l'élaboration de cet ouvrage : Afrique centrale : cadres juridiques et pratiques du pluralisme radiophonique. Dans cette région d'Afrique, dont plusieurs pays ont connu, au cours des dernières années, des conflits violents ou des troubles importants, l'outil radiophonique joue un rôle essentiel dans les processus de reconstruction et de consolidation démocratique. Quel type de juridiction de proximité peut-on instituer au Congo pour satisfaire aux besoins de justice de la population? Un regard croisé sur les systèmes juridictionnels congolais et français peut-il produire un effet de mixage capable de rapprocher la justice congolaise de ses usagers? Cette étude adopte une approche de métissage du droit coutumier, du droit moderne et des structures parallèles de règlement des conflits, fonctionnant dans un système de foisonnement pluriel et multiforme. Abolis par une loi de 2013, les tribunaux de police et les tribunaux coutumiers jouaient un rôle majeur dans la justice de proximité en RDC. De la mise en parallèle des systèmes congolais et français à une enquête de terrain, aussi bien auprès des juridictions françaises de proximité, qu'auprès des tribunaux de paix de Kinshasa, cette étude permet de comprendre la complexité du système juridictionnel de proximité au Congo et dévoile ses dysfonctionnements. Posant un regard critique sur le passé et s'inspirant du système français, l'auteur tente de mieux envisager l'avenir par une analyse pertinente des différentes juridictions officielles et des structures informelles de résolution des conflits, afin de proposer la refondation de véritables juridictions de proximité au Congo.
