La loi relative à la transition énergétique pour la croissance verteLa loi repose sur un postulat : la nécessité d’accroître la liberté de choix du consommateur, non seulement sur les sources d’énergie, en développant les énergies renouvelables, non seulement sur ses fournisseurs, mais également sur la connaissance et la maîtrise de sa consommation. Celle-ci implique la rénovation de l’habitat, une meilleure appréhension de la consommation - à laquelle contribuent les compteurs déportés d’électricité et de gaz, mais aussi, par exemple, l’individualisation des compteurs de chauffage dans les habitats collectifs, le développement de modes de transports alternatifs, dont le covoiturage ou la mise en place de flottes de vélos dans les entreprises, ou encore de l’autoconsommation. a comme objectifs tant la réduction de la consommation énergétique que le recours à des sources décarbonées et diversifiées de mix énergétique. Elle concerne, au plan matériel, les secteurs les plus divers de l’activité sociale, des plus quotidiens : circulation des véhicules, sacs et objets de cuisine en plastique, tri des déchets, constructions de bâtiments neufs et rénovations, implantation d’éoliennes, covoiturage, circulation en vélo, remplacement des compteurs électriques et de gaz, consommation d’énergie, aux plus structurants en termes d’enjeux d’avenir : plafonnement en volume de la part d’énergie d’origine nucléaire, démantèlement de réacteurs, prix de l’électricité, rôle et financement d’EDF, d’AREVA ou d’ENGIE, précarité énergétique, filières industrielles, etc. .. Plus largement, la loi contribue à la mise en œuvre de principes qui excèdent les seules questions énergétiques : solidarité, citoyenneté, participation du public à la décision environnementale, aménagement du territoire, santé publique, etc. Le développement durable ne peut être aujourd’hui appréhendé qu’à travers une approche transversale. Les points d’entrée sont donc multiples, comme le sont les grilles d’analyse, en termes d’emploi industriel, d’efficacité des mesures, de droit de l’urbanisme ou de concessions de service public. L’une des difficultés de l’évaluation de la présente loi est qu’elle vise souvent, plutôt qu’à prescrire ou à prohiber, à inciter à des comportements, et que donc, l’effet de mesures peut être contrarié par de nombreux facteurs : entrée en vigueur tardive, contentieux, campagnes d’ « information » véhiculant des idées parfois caricaturales, voire fausses : complexité des procédures, poids des réglementations, divergence entre les acteurs, situation économique du marché de l’énergie, corporatismes, etc. Si elle cherche bien à contribuer à cette modification des comportements, la « transition » n’en est pas moins par nature un état instable. Nombre de professionnels regrettent l’incertitude sur les normes, leur instabilité, leur excessive technicité. Une autre difficulté tient à la diversité même des dispositions et des secteurs concernés.
