The ever-increasing release of harmful agents due to human activities have led in some areas of the world to heavy pollution. In order to protect human health and the environment, environmental standards that shall limit the release and the concentration of those toxic agents in the environment and hence the exposure to it have to be established. The related assessment and decision-making procedures have to be based on solid scientific data about the effects and mechanisms of these agents as well as on ethical, social and economic aspects. For risk evaluation, the knowledge of the dose response curve is an essential prerequisite. Dose responses without a threshold dose are most critical in this connection. Such dose responses are assumed for mutagenic and carcinogenic effects, which, therefore, dominate also the discussion in this book. In the environmentally important low dose range, risk estimation can only be achieved by extrapolation from higher doses with measurable effects. The extrapolation is accompanied with uncertainties which makes risk evaluation as well as risk communication frequently problematic. In order to ensure rational efficient and fair decisions beyond a sound scientific assessment the dialogue between disciplines, with the affected people and with the general public is necessary. In this book, the whole range of relevant and essential aspects of risk evaluation and standard setting is addressed. Starting with the ethical foundations, the sound analysis of recent scientific findings sets the frame for further reflections by theory of cognition, psychosocial sciences, and jurisprudence. The authors end up with concluding recommendations for coping with the recent problems of standard setting in the field of environmentally relevant low doses. This volume contains papers presented in a workshop of international experts in September 2008 in Berlin. The experts discussed how environmental consequences of EU legislation can be incorporated in a more effective way. English summary: EMAS is generally regarded as a classic example of social self-regulation. However, the widespread lack of EMAS certification shows that in the discussion surrounding the governmental instruments of environmental policy on the one hand and forms of social self-regulation on the other hand the main issue must not be alternative solutions but rather cumulative solutions. Christoph Leifer studies the question of the correct relationship and the interaction between both parts in the case of the EMAS and examines whether or not the advantages of social self-regulation systems are being used without disregarding the protective obligations of the government as well as private positions on fundamental rights in order to achieve efficiency in the entire system. German description: Seit seiner Einfuhrung im Jahr 1993 wurde das europaische Gemeinschaftssystem fur das Umweltmanagement und die Umweltbetriebsprufung (EMAS) als ein Schulbeispiel gesellschaftlicher Selbstregulierungssysteme genannt. Derartige Systeme werden haufig als neue Steuerungsform und sogar als Alternative zu dem gerade aus systemtheoretischer und umweltokonomischer Sicht in die Kritik geratenen Umweltordnungsrecht propagiert. Insbesondere die mangelnde Verbreitung der EMAS-Zertifizierung zeigt jedoch, dass es bei der Diskussion uber ordnungsrechtlich-staatliche Instrumente der Umweltpolitik einerseits und Formen der gesellschaftlichen Selbstregulierung andererseits keineswegs um alternative, sondern vielmehr um kumulative Losungen gehen muss, die insbesondere die Frage nach dem richtigen Verhaltnis und der Verschrankung beider Teile aufwirft. Christoph Leifer geht dieser Frage im Fall des europaischen Umweltmanagementsystems EMAS nach und pruft, ob hierbei einerseits die Vorteile gesellschaftlicher Selbstregulierungssysteme genutzt werden, ohne andererseits die staatlichen Schutzpflichten und privaten Grundrechtspositionen ausser acht zu lassen, um so zu einer Effizienz des Gesamtsystems zu gelangen. Anschliessend untersucht er, wie das System der Selbstregulierung in Form der EMAS-Zertifizierung im Gesamtgefuge der Wirtschafts- und Umweltrechtsordnung verankert ist und welche Auswirkungen diese im Rahmen des Jahresabschlusses, bei der Vergabe offentlicher Auftrage und bei der Risikoeinschatzung auf Grund umwelthaftungsrechtlicher Bestimmungen sowie deren Versicherbarkeit hat.
