This book explores the value for literary studies of the model of communication known as relevance theory. Drawing on a wide range of examples—lyric poems by Yeats, Herrick, Heaney, Dickinson, and Mary Oliver, novels by Cervantes, Flaubert, Mark Twain, and Edith Wharton—nine of the ten essays are written by literary specialists and use relevance theory both as a broad framing perspective and as a resource for detailed analysis. The final essay, by Deirdre Wilson, co-founder (with Dan Sperber) of relevance theory, takes a retrospective view of the issues addressed by the volume and considers the implications of literary studies for cognitive approaches to communication. Relevance theory, described by Alastair Fowler as 'nothing less than the makings of a radically new theory of communication, the first since Aristotle's', offers a comprehensive pragmatics of language and communication grounded in evidence about the ways humans think and behave. While designed to capture the everyday murmur of conversation, gossip, peace-making, hate speech, love speech, 'body-language', and the chatter of the internet, it covers the whole spectrum of human modes of communication, including literature in the broadest sense as a characteristically human activity. Reading Beyond the Code is unique in using relevance theory as a prime resource for literary study, and it is also the first to claim that the model works best for literature when understood in the light of a broader cognitive approach, focusing on a range of phenomena that support an 'embodied' conception of cognition and language. Legal issues of personal status – including those implicating women's rights – continue to be a focal area of shari'a judicial practice in the Muslim world. Changing ideas of marriage, relations between the spouses, divorce, and the rights of divorcees and widows challenge the courts around the Arab world. In this context, the areas that came under the Palestinian Authority in 1994 command particular attention: the particular political and socio-economic circumstances that surround Palestine's progress toward full statehood have created a remarkable crucible for the synthesis of a new family law in the Arab world. This rigorous study of the interpretation and application of personal status law in the Palestinian West Bank (and to a lesser extent in the Gaza Strip) is the most extensive yet attempted. It presents a systematic analysis of the application of Islamic family law in nearly 10,000 marriage contracts, 1000 deeds of talaq (unilateral divorce) or khul' (divorce with renunciation), and 2000 judicial rulings over a time span that includes Jordanian rule and Israeli military occupation, updating this with material from the beginning of the jurisdiction of the Palestinian Authority. Taken into account are the sources of law used in the shari'a courts of the West Bank: the successive codes of family law (the Jordanian Law of Personal Status 1976 and its predecessor the Jordanian Law of Family Rights 1951), and traditional Hanafi rules and texts, along with commentaries by prominent contemporary shari'a scholars and Appeal Court decisions – as well as the amendments and modifications being sought by civil society actors (notably women's groups) in the West Bank and Gaza Strip, as well as in Jordan.

A history of the idea of “relevance” since the nineteenth century in art, criticism, philosophy, logic, and social thought. Before 1800 nothing was irrelevant. So argues Elisa Tamarkin’s sweeping meditation on a key shift in consciousness: the arrival of relevance as the means to grasp how something that was once disregarded, unvalued, or lost to us becomes interesting and important. When so much makes claims to our attention every day, how do we decide what is most valuable right now? Relevance, Tamarkin shows, was an Anglo-American concept, derived from a word meaning “to raise or to lift up again,” and also “to give relief.” It engaged major intellectual figures, including Ralph Waldo Emerson and pragmatists and philosophers—William James, Alain Locke, John Dewey, and Alfred North Whitehead—as well as a range of critics, phenomenologists, linguists, and sociologists. Relevance is a struggle for recognition, especially in the worlds of literature, art, and criticism. This book develops three models to help answer that question: inquiry, artefacts and imagination. Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. To imagine, in turn, is to enter a distinctive epistemic frame where we temporarily suspend certain epistemic norms and commitments and participate actively along a spectrum of affective, sensory and kinesic involvement. The book argues that artefacts and related processes of imagination are valuable insofar as they enable inquiry in adjudication, ie the social (interactive and collective) process of making insight into what values, vulnerabilities and interests might be at stake in a case and in similar cases in the future. Artefacts of Legal Inquiry is structured in two parts, with the first offering an account of the three models of inquiry, artefacts and imagination, and the second examining four case studies (fictions, metaphors, figures and scenarios). Drawing on a broad range of theoretical traditions – including philosophy of imagination and emotion, the theory and history of rhetoric, and the cognitive humanities – this book offers an interdisciplinary defence of the importance of artefactual language and imagination in adjudication.

This volume brings together scholars of both the Old and New Testaments to discuss three areas of methodological interest in respect of the use of the Old Testament in the New (OT/NT).
