Studienarbeit aus dem Jahr 2016 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Note: 1,4, Fachhochschule der Sächsischen Verwaltung Meißen, Sprache: Deutsch, Abstract: Sexuelle Belästigung wurde in Deutschland im Rahmen der „Busengrapscher-Affäre“ im Jahr 1983 erstmals rechtspolitisch diskutiert. Ein Bundestagsabgeordneter der Grünen hatte Mitarbeiterinnen der Fraktion belästigt. Anfangs stand die Öffentlichkeit diesem Thema noch sehr zurückhaltend gegenüber. Sexuelle Belästigung wurde als seltenes, individuelles Fehlverhalten verstanden. Diese Auffassung war angesichts des Forschungsstands seit den 1980er Jahren nicht erklärlich, schließlich war bekannt, dass sexuelle Belästigung weit verbreitet ist und dass die persönlichen, gesundheitlichen und sozialen Folgen so schwerwiegend sind, dass auch rechtliche Maßnahmen unverzichtbar erscheinen. Als erste umfassende Regelung zum Schutz vor sexueller Belästigung am Arbeitsplatz trat im Juni 1994 das Beschäftigtenschutzgesetz (BeschSchG) in Kraft. Es gewährte Beschwerderechte sowie Schadensersatz- und Entschädigungsansprüche für die Betroffenen. Zur Umsetzung europäischer Richtlinien wurde das BeschSchG 2006 durch das umfassendere Allgemeine Gleichbehandlungsgesetz (AGG) abgelöst. Das AGG verbietet jede Form der sexuellen Belästigung am Arbeitsplatz und verpflichtet den Arbeitgeber, vorzubeugen und einzugreifen, wenn es zu Übergriffen kommt. Diese Arbeit definiert zunächst den Begriff der sexuellen Belästigung und erläutert ihre Erscheinungsformen. Anschließend werden die Reaktionsnotwendigkeiten und möglichkeiten des Arbeitgebers auf sexuelle Belästigung am Arbeitsplatz im Rahmen des AGG dargestellt und mithilfe aktueller Rechtsprechung umfassend beleuchtet.

And recent cases in the media about the sexualised abuse of power in institutions such as universities, Parliament and Hollywood highlight the prevalence and damaging impact of GBV. In this book, academics and practitioners provide the first in-depth overview of research and practice in GBV in universities. They set out the international context of ideologies, politics and institutional structures that underlie responses to GBV in elsewhere in Europe, in the US, and in Australia, and consider the implications of implementing related policy and practice. A Thai foodseller on the streets of Bangkok, a cyclo driver in a Vietnamese village, a Pahari migrant laborer in the Himalayas, a Parsi-Christian professional social worker shuttling back and forth between London and Calcutta—Trans-Status Subjects examines how these and other South and Southeast Asians affect and are affected by globalization. While much work has focused on the changes wrought by globalization—describing how people maintain foundations or are permanently destabilized—this collection theorizes the complex ways individuals negotiate their identities and create alliances in the midst of both stability and instability, as what the editors call trans-status subjects. Using gender paradigms, historical time, and geographic space as driving analytic concerns, the essays gathered here consider the various ways South and Southeast Asians both perpetuate and resist various hierarchies despite unequal mobilities within economic, social, cultural, and political contexts. Public policy responses to child sexual abuse are dominated by interventions designed to take effect only after offenders have already begun offending, and after children have already been sexually abused. Comparatively little attention has been given to alternative prevention strategies – particularly to those aimed at preventing sexual abuse before it might otherwise occur. Considerable knowledge has been accumulated on the characteristics, modus operandi and persistence of offenders, the characteristics, circumstances and outcomes for victims, and the physical and social settings in which sexual abuse occurs, but little work has been done to systematically apply this knowledge to prevention. This book aims to fulfill this objective through integrating clinical and criminological concepts and knowledge to inform a more comprehensive and effective public policy approach to preventing child sexual abuse.
