Studienarbeit aus dem Jahr 2016 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Note: 1,4, Fachhochschule der Sächsischen Verwaltung Meißen, Sprache: Deutsch, Abstract: Sexuelle Belästigung wurde in Deutschland im Rahmen der „Busengrapscher-Affäre“ im Jahr 1983 erstmals rechtspolitisch diskutiert. Ein Bundestagsabgeordneter der Grünen hatte Mitarbeiterinnen der Fraktion belästigt. Anfangs stand die Öffentlichkeit diesem Thema noch sehr zurückhaltend gegenüber. Sexuelle Belästigung wurde als seltenes, individuelles Fehlverhalten verstanden. Diese Auffassung war angesichts des Forschungsstands seit den 1980er Jahren nicht erklärlich, schließlich war bekannt, dass sexuelle Belästigung weit verbreitet ist und dass die persönlichen, gesundheitlichen und sozialen Folgen so schwerwiegend sind, dass auch rechtliche Maßnahmen unverzichtbar erscheinen. Als erste umfassende Regelung zum Schutz vor sexueller Belästigung am Arbeitsplatz trat im Juni 1994 das Beschäftigtenschutzgesetz (BeschSchG) in Kraft. Es gewährte Beschwerderechte sowie Schadensersatz- und Entschädigungsansprüche für die Betroffenen. Zur Umsetzung europäischer Richtlinien wurde das BeschSchG 2006 durch das umfassendere Allgemeine Gleichbehandlungsgesetz (AGG) abgelöst. Das AGG verbietet jede Form der sexuellen Belästigung am Arbeitsplatz und verpflichtet den Arbeitgeber, vorzubeugen und einzugreifen, wenn es zu Übergriffen kommt. Diese Arbeit definiert zunächst den Begriff der sexuellen Belästigung und erläutert ihre Erscheinungsformen. Anschließend werden die Reaktionsnotwendigkeiten und möglichkeiten des Arbeitgebers auf sexuelle Belästigung am Arbeitsplatz im Rahmen des AGG dargestellt und mithilfe aktueller Rechtsprechung umfassend beleuchtet.
