Wat heeft kunst te betekenen voor het denken over het recht? Wat draagt literatuur bij aan het begrip daarvan? In welke zin is het recht zelf esthetisch geconditioneerd, zoals een kunstwerk? Kan het rechterlijk oordeel worden opgevat als een esthetisch oordeel en in hoeverre behoort het dat te zijn? Deze vragen zijn binnen de rechtsgeleerdheid nog nauwelijks aan de orde gekomen. Onder invloed van het rationalisme en het positivisme is het recht voornamelijk als een wetenschap benaderd. Vanuit dit wetenschappelijk perspectief bezien moesten kunst en recht principieel onverenigbaar en tegenstrijdig lijken. In strijd met dit nog altijd heersende wetenschappelijk paradigma worden in deze bundel de kunstzinnige dimensies van het recht verkend. Deze literaire of esthetische benadering blijkt van onschatbare waarde voor de theorie en de praktijk van rechtsvinding. Fundamenten voor deze alternatieve opvatting vinden wij in de moderne existentiefilosofie: in het hier besproken werk van Kierkegaard, Nietzsche, Dostojevski, Unamuno, Kafka, Sartre en Camus. De levensbeschouwing van deze denkers heeft zich vooral ontwikkeld onder invloed van de literatuur. Deze blijkt tevens de inspiratie te zijn tot een existentiële en poëtische rechtsfilosofie die het recht wil zien vanuit het perspectief van het leven en het menselijk bestaan: als een schepping van vorm die kunst genoemd kan worden. Eva, a 1927 novel by Dutch writer Carry van Bruggen, is an experiment in depicting a woman’s life from girlhood to marriage, and beyond, to sexual freedom and independence. At the same time, the narrative expresses Eva’s dawning sense of self and expanding subjectivity through a stream of consciousness told by a shifting narrator. Burdened all of her life by feelings of shame, at the end of the novel Eva overcomes this legacy of her upbringing and declares that it is ‘bodily desire that makes love acceptable’. Carry van Bruggen’s rich and varied language conveys Eva’s experience of the world. Powerful memories of an orthodox Jewish childhood pervade the novel with its fluid sense of time. As Eva puts it, ‘I let these years slip through my fingers like a stream of dry, glinting sand.’ Jane Fenoulhet makes this important modernist novel accessible to English readers for the first time. While it can be described as a becoming-woman of both Eva and her creator, so can the translation be seen as the translator’s own becoming, as Fenoulhet explains in the accompanying commentary, where she also describes the challenges of translating van Bruggen’s dynamic, intense narrative. For Fenoulhet, translation is more a matter of personal engagement with the novel than a matter of word choice and style. In this way, the emotional and intellectual life of the main character is re-enacted through translation.

This volume contains Hugo Grotius' first work in the field of Church politics, orginally published in 1613. The book was written to defend the policy of the States of Holland, which was being attacked by the orthodox Calvinistic party in the Netherlands. It was written with an eye to foreign Dutch allies, especially King James I. Grotius' Latin text is here edited critically for the first time and provided with an introduction, an English translation and an extensive commentary. In several appendixes, various texts that are important for the background and the reception of the book are printed, many of them for the first time. Ordinum Pietas is one of the key texts for the knowledge of the religious disputes in the Netherlands during the Twelve Years' Truce (1609-1621).
