Die Wirren und Umbrüche zunächst in der zweiten Hälfte des 20. Jahrhunderts und dann noch einmal um die Jahrtausendwende haben einen Rückfall in traditionelle Gesellschaftsstrukturen hervorgebracht, welche nach allgemeinen, zumindest aber nach westlichen Maßstäben in vielerlei Hinsicht nicht denen eines geordneten Staates entsprechen. Gleichzeitig üben quasistaatliche Akteure in unterschiedlicher Intensität (Staats-)Gewalt aus. Sämtliche Aspekte des Lebens – der soziale Bereich, aber auch der bloße Lebenserhalt – werden von verschiedensten Faktoren mit schwankender Verlässlichkeit bestimmt und reguliert. Eine Staatlichkeit, welche im Sinne eines Gewaltmonopols körperliche Sicherheit, individuelle Rechte und Mechanismen zu ihrer Durchsetzung bietet existiert – wenn überhaupt – nur lokal, jedenfalls aber nicht flächendeckend. Stattdessen konkurrieren verschiedenste Gruppen im Rahmen verschiedener Systeme darum, alleinbestimmend oder als Faktor in einem pluralistischen System regulierend zu wirken. Der Versuch der Etablierung einer auf einer Verfassung basierenden Staatsgewalt über das gesamte (völkerrechtliche) Staatsgebiet Somalias wird sowohl aus Teilen der Bevölkerung selbst als auch maßgeblich von externen Akteuren betrieben, gleichzeitig spielt auf lokaler Ebene noch immer das überkommene, seit Jahrhunderten gelebte Gewohnheitsrecht eine ausschlaggebende Rolle in der Regelung der Beziehungen zwischen einzelnen Individuen und zwischen den sozialen Gruppen. Auch das ebenfalls seit langer Zeit einflussreiche islamische Recht gewinnt vor allem seit der Jahrtausendwende wieder erheblich an gesellschaftlicher Relevanz, nachdem es zwischenzeitlich während der Diktatur Siad Barres einen Bedeutungsverlust erlitten hatte. Schließlich stellen auch Initiativen aus der Zivilgesellschaft und Bestrebungen auf der Ebene der internationalen Staatengemeinschaft Faktoren in der Ausgestaltung des somalischen Rechtssystems dar, welche einen lebhaften Rechtspluralismus begünstigen. Vor dem Hintergrund dieses pluralistischen Feldes unternimmt die vorliegende Arbeit den Versuch, die unterschiedlichen Rechtsquellen und Durchsetzungsmechanismen zu skizzieren und die hierbei bestehenden Interdependenzen darzustellen. Hierzu wird zunächst in einem einleitenden Teil die Frage nach dem Inhalt und der Bedeutung von „Rechtspluralismus“ umrissen.
