Nach deutscher Rechtstradition sind Rechtsschutzversicherer grundsätzlich daran gehindert, Rechtsdienstleistungen gegenüber ihren Versicherten zu erbringen. Dies gilt auch für den außergerichtlichen und außerbehördlichen Bereich. Bei der Neuregelung der Materie ist diese Rechtstradition in § 4 RDG ausdrücklich bestätigt worden. Dahinter steht der Gedanke, dass die Erbringungen von Rechtsdienstleistungen für die Rechtsschutzversicherer zu einem Konflikt mit dem wirtschaftlichen Interesse an der Vermeidung der mit der Rechtsverfolgung verbundenen Kosten führen kann. In anderen Rechtsordnungen (z. B. Niederlande, Österreich) ist den Rechtsschutzversichern dagegen die Erbringung von Rechtsdienstleistungen für die Versicherten im außergerichtlichen Bereich nicht verwehrt. Die Rechtsschutzversicherungs-Richtlinie vom 22.6.1987 (RL 87/344/EWG) und die Solvency Il-Richtlinie vom 25.11.2009 (RL 2009/138/EG) sehen ebenfalls keine diesbezüglichen Einschränkungen vor. Die Untersuchung von Ingo Weckmann wendet sich zunächst dem Begriff der Rechtsdienstleistung, dem Berufsbild des Rechtsanwalts sowie dem Produkt der Rechtsschutzversicherung zu. Auf der Grundlage wird die Betätigung von Rechtsschutzversicherern als Rechtsdienstleister erörtert. Dabei werden nicht nur die Leistungen nach den ARB 2012 auf ihre Konformität hin untersucht, sondern es werden auch weitere Modelle der Leistungserbringung beleuchtet. Ein Schwerpunkt der Arbeit bildet die Frage, ob die sehr restriktive Regelung des § 4 RDG aus verfassungs- und europarechtlicher Sicht haltbar ist. Abschließend formuliert der Autor einen konkreten Vorschlag für die Änderung des § 4 RDG. Die Arbeit richtet sich nicht nur an Wissenschaftler, sondern auch an Praktiker, die sich mit Frage beschäftigen, wie weit sich Rechtsschutzversicherer vom Kostenerstatter zum (Rechts-)Dienstleister entwickeln können.

Despite western Europe's traditional disdain for the United States' "adversarial legalism," the European Union is shifting toward a very similar approach to the law, according to Daniel Kelemen. Coining the term "eurolegalism" to describe the hybrid that is now developing in Europe, he shows how the political and organizational realities of the EU make this shift inevitable. The model of regulatory law that had long predominated in western Europe was more informal and cooperative than its American counterpart. It relied less on lawyers, courts, and private enforcement, and more on opaque networks of bureaucrats and other interests that developed and implemented regulatory policies in concert. European regulators chose flexible, informal means of achieving their objectives, and counted on the courts to challenge their decisions only rarely. Regulation through litigation-central to the U.S. model-was largely absent in Europe. But that changed with the advent of the European Union. Kelemen argues that the EU's fragmented institutional structure and the priority it has put on market integration have generated political incentives and functional pressures that have moved EU policymakers to enact detailed, transparent, judicially enforceable rules-often framed as "rights"-and back them with public enforcement litigation as well as enhanced opportunities for private litigation by individuals, interest groups, and firms.
