März 2012, Sprache: Deutsch, Abstract: Vom 12. bis 24. März 2012 fand in Kyoto an der Doshisha Law School ein Intensivseminar „Japanese Law Program“ statt. Das Seminar gliederte sich in drei Teile: Vorlesungen zu verschiedenen Rechtsgebieten, aus einem Symposium zum Thema „Zur Bedeutung des Vergleichs von Rechtskulturen“, sowie einem Besuchsprogramm, das Besuche bei der JVA Kyoto, bei der Staatsanwaltschaft und der Abteilung für Internationale Zusammenarbeit des Justizministeriums in Osaka, sowie Besuche der Rechtsabteilungen bei PANASONIC in Osaka und bei OMRON in Kyoto beinhaltete. Im Vorlesungsteil wurden die folgenden Rechtsgebiete behandelt: Straf- und Strafprozessrecht, Verfassungs- und Verwaltungsrecht, Japanische Rechtsgeschichte, Japanisches Zivilrecht, Gesellschaftsrecht, Arbeitsrecht, Umweltrecht, Zivilprozessrecht und Internationales Privatrecht. Zudem wurde zu Beginn des Kurses eine Einführung zur Juristenausbildung und zum Justizsystem in Japan gegeben, auch wurde ein Videobeitrag zum Kriegsverzichtsartikel 9 in der Japanischen Verfassung gezeigt. In der vorliegenden Arbeit sollen die verschiedenen Inhalte der Vorlesungen, der Vorträge im Symposium und die Informationen aus dem Besuchsprogramm zusammengefasst dargestellt werden. Aufgrund besonderem Interesse des Verfassers, der seit vielen Jahren als Berufsbetreuer arbeitet, wird auch dem Thema Betreuungsrecht für Volljährige ein eigener Abschnitt gewidmet.

Death penalty: A cruel and inhuman punishment is an academic contribution by Academics for abolition aimed at fostering the debate launched by the United Nations General Assembly in its resolution 62/149 on 18 December 2007, calling for a worldwide moratorium on executions by 2015, and continued by the upcoming review process of the UN’s Millennium Development Goals (MDG). It is mainly a compilation of papers written by the speakers at the Seminar “Against cruel and inhuman punishment and death penalty”, which took place at the Real Academia de Bellas Artes de San Fernando, in Madrid, on 9 June 2013, on the eve of the 5th World Congress against the death penalty. The book deals with current issues of the process towards abolition as the lack of evidence about the deterrence effect of death penalty and its consideration as a cruel and inhuman punishment. Together with the editors, the contribution includes studies, among others, of H.J. Albrecht, Gabrio Forti, Roger Hood, Salim Himnat and Sergio García Ramírez. The Academic International Network against the Death Penalty (REPECAP) dedicates this book to the International Commission against the Death Penalty (ICDP) chaired by Federico Mayor Zaragoza.

This work focuses on a specific aspect of the enforcement of maritime claims, namely judicial sales of ships, a procedure creditors typically resort to in the event of an irreversible default situation. A substantial part of the book approaches the topic from a comparative perspective, the goal being to assess the similarities and differences of the judicial sale procedure between three specific jurisdictions: Belgium, the Netherlands, and England & Wales. In this study, the comparison is used to further analyse the impacts of these differences on the effectiveness and reliability of the judicial sale procedure in each jurisdiction and also forms the basis for assessing the feasibility of harmonising judicial sale procedures and fostering their acceptance. Considering the international character typical of judicial sales of ships, conflict-of-law questions are very likely to arise during these procedures. Accordingly, the comparative study, where appropriate, is viewed against a private international law background.

The book provides rule-by-rule commentaries on European contract law (general contract law, consumer contract law, the law of sale and related services), dealing with its modern manifestations as well as its historical and comparative foundations. After the collapse of the European Commission's plans to codify European contract law it is timely to reflect on what has been achieved over the past three to four decades, and for an assessment of the current situation. In particular, the production of a bewildering number of reference texts has contributed to a complex picture of European contract laws rather than a European contract law. The present book adopts a broad perspective and an integrative approach. All relevant reference texts (from the CISG to the Draft Common European Sales Law) are critically examined and compared with each other. As far as the acquis commun (ie the traditional private law as laid down in the national codifications) is concerned, the Principles of European Contract Law have been chosen as a point of departure. The rules contained in that document have, however, been complemented with some chapters, sections, and individual provisions drawn from other sources, primarily in order to account for the quickly growing acquis communautaire in the field of consumer contract law. In addition, the book ties the discussion concerning the reference texts back to the pertinent historical and comparative background; and it thus investigates whether, and to what extent, these texts can be taken to be genuinely European in nature, ie to constitute a manifestation of a common core of European contract law. Where this is not the case, the question is asked whether, and for what reasons, they should be seen as points of departure for the further development of European contract law.
