This book discusses the dominant corrective justice and distributive justice approaches to private law and identifies their strengths and weaknesses. It goes on to propose a general approach to private law, including contract, tort and private property, and explains how it can provide solutions to some longstanding problems. Two general ideas inform this approach: the 'standpoint limitation' and 'remedial consistency'. The standpoint limitation explains the distinctive character of private law, that is to say why it is focussed mainly, though not exclusively, on particular individual interests rather than the common welfare. Remedial consistency explains the way in which remedies depend on and give effect to primary rights. The book also discusses the nature of common law legal reasoning and its relationship to the suggested understanding of private law.

It is time to re-examine the French Revolution as a political resource. The historiography has so far ignored the question of popular sovereignty and emancipation; instead the Revolution has been vilified as a matrix of totalitarianisms by the liberals and as an ethnocentric phenomenon by postcolonial studies. This book examines why. More so than historians, it is philosophers that have played the leading role in the portrayal of this major event in French political history. The philosophical quarrels of the 1960s placed the French Revolution at the heart of their debates. The most well-documented among these is the conflict between Jean-Paul Sartre and Claude Lévi-Strauss and subsequently, Michel Foucault. Do we need an ethics of the history of the French Revolution? Rancière, Derrida, Balibar, Lefort, Robin, and Loraux can help answer this question, in an epistemological approach to history. These successive explorations allow us to move away from a myth of identity and to rediscover a real Revolution, capable of offering Enlightenment and political utility and interrogating what democracy and emancipation mean for us today.

One of the distinguishing features of Drucilla Cornell's work is its emphasis on the significance of ideals. The essays collected here examine how the ideals of freedom and equality associated with the democratic revolutions of the West have survived the challenges of twentieth century critiques. Cornell argues that, far from threatening these ideals, feminism, race theory and other new theories have deepened their meaning and so allowed them to survive. In particular, Cornell here engages with issues surrounding representation and rights. Drawing on her experiences as a union organizer, she recounts how workers, and in particular women workers, came to imagine themselves in a way that allowed them to engage in political activism. The kind of representation-- the imaginative acts by which we envisage the world and our role in it-- is entwined, she argues, with struggles for representation in democratic practice. Cornell's work on law also reveals her vision of the role of the ideal. Included here are two of her most important contributions to legal theory--her well-known defense of worker's rights (also included is the response to her essay by Judge Richard Posner) and her ground-breaking defense of Spanish-language rights.

Theories of justice often fixate on purely normative, abstract principles unrelated to real-world applications. The philosopher and theorist Axel Honneth addresses this disconnect, constructing a theory of justice derived from the normative claims of Western liberal-democratic societies and anchored in the law and institutionally established practices that possess moral legitimacy. Termed a “democratic ethical life,” Honneth’s paradigm draws on the spirit of Hegel’s Philosophy of Right and his own theory of recognition, demonstrating how concrete social spheres generate the principles of individual freedom and a standard for what is just. Using social analysis to re-found a more grounded theory of justice, Honneth argues that all crucial actions in Western civilization, whether in personal relationships, market-induced economic activities, or the public forum of politics, share one defining characteristic: they require the realization of a particular aspect of individual freedom. This fundamental truth, Honneth shows, informs the guiding principles of justice, enabling a wide-ranging reconsideration of its theory.
