Marrying legal doctrine from five pioneering and conversant jurisdictions with contemporary political philosophy, this book provides a general theory of discrimination law. Part I gives a theoretically rigorous account of the identity and scope of discrimination law: what makes a legal norm a norm of discrimination law? What is the architecture of discrimination law? Unlike the approach popular with most textbooks, the discussion eschews list-based discussions of protected grounds, instead organising the doctrine in a clear thematic structure. This definitional preamble sets the agenda for the next two parts. Part II draws upon the identity and structure of discrimination law to consider what the point of this area of law is. Attention to legal doctrine rules out many answers that ideologically-entrenched writers have offered to this question. The real point of discrimination law, this Part argues, is to remove abiding, pervasive, and substantial relative group disadvantage. This objective is best defended on liberal rather than egalitarian grounds. Having considered its overall purpose, Part III gives a theoretical account of the duties imposed by discrimination law. A common definition of the antidiscrimination duty accommodates tools as diverse as direct and indirect discrimination, harassment, and reasonable accommodation. These different tools are shown to share a common normative concern and a single analytical structure. Uniquely in the literature, this Part also defends the imposition of these duties only to certain duty-bearers in specified contexts. Finally, the conditions under which affirmative action is justified are explained.

Desde finales del siglo XX ha existido relativo consenso en prácticamente todos los ordenamientos jurídicos respecto a que la justicia civil se encuentra en un profundo estado de crisis. Ello ha obligado a la comunidad jurídica integrada por académicos, jueces y juezas, abogados y abogadas litigantes y operadores del sistema a replantearse el diseño, estructura y práctica del proceso referido a la reivindicación judicial de intereses de orden civil. El primer paso ha sido intentar cambiar el foco desde un proceso civil, de suyo centrado en códigos y leyes procesales que apuntan a la regulación de procedimientos, trámites, actuaciones y recursos, por un concepto panóptico y holístico de justicia civil, en el que se consideran ángulos y prismas más amplios y transversales, que van desde el diseño orgánico hasta el sustento ideológico detrás de las normas procesales. En ese sentido, la necesidad de establecer una visión tridimensional de la justicia se ha erigido como respuesta común en todos los ordenes jurisdiccionales, en los que la búsqueda de la solución correcta debe congeniarse con dimensiones asociadas al tiempo y al costo incurrido. Esta obra se propone, con las limitaciones propias de nuestros tiempos y circunstancias, constituir un aporte a esas reflexiones sobre la construcción de un sistema de justicia civil moderno, que pueda dar cabida a las necesidades de los justiciables respecto de una serie amplia y diversa de intereses jurídicos cuyo conocimiento esta entregado a los tribunales con competencia civil. En esa liza, se ha ensayado un catálogo de artículos sobre los temas que mayor interés despierta la mencionada tarea de repensar el proceso civil, abarcando desde cuestiones orgánicas estructurales hasta los mecanismos en que la justicia civil cierra el sistema mediante las reglas de definitividad, pasando por críticas económicas y filosóficas al sistema de justicia civil, a su construcción material y teórica, así como un reflejo de un estatuto sustantivo patriarcal y privatista, propio del ideario político, económico y social liberal de siglos pasados. En la obra el lector podrá encontrar problemas pocas veces mencionados en la literatura, pero que hoy suponen un andamio insoslayable en la arquitectura del análisis de la justicia civil, tales como el problema de los costos, el acceso, la asistencia jurídica, el rol de la profesión letrada, los mecanismos alternativos de resolución y las facultades y poderes del juez en la conducción del procedimiento. Para ello, se ha contado con la colaboración de un distinguido número de profesores y profesoras que gentilmente han querido colaborar en estas reflexiones, así como noveles estudiantes que han terminado sus estudios de derecho escribiendo sobre materias hasta hace poco desconocidas en los syllabus de pregrado.
