Attempts to understand various aspects of the empirical world often rely on modelling processes that involve a reconstruction of systems under investigation. Typically the reconstruction uses mathematical frameworks like gauge theory and renormalization group methods, but more recently simulations also have become an indispensable tool for investigation. This book is a philosophical examination of techniques and assumptions related to modelling and simulation with the goal of showing how these abstract descriptions can contribute to our understanding of the physical world. Particular issues include the role of fictional models in science, how mathematical formalisms can yield physical information, and how we should approach the use of inconsistent models for specific types of systems. It also addresses the role of simulation, specifically the conditions under which simulation can be seen as a technique for measurement, replacing more traditional experimental approaches. Inherent worries about the legitimacy of simulation "knowledge" are also addressed, including an analysis of verification and validation and the role of simulation data in the search for the Higgs boson. In light of the significant role played by simulation in the Large Hadron Collider experiments, it is argued that the traditional distinction between simulation and experiment is no longer applicable in some contexts of modern science. Consequently, a re-evaluation of the way and extent to which simulation delivers empirical knowledge is required. Reconstructing Reality in the Courtroom explains what makes stories believable and how ordinary people connect complex legal arguments and evidence presented in trials to assess guilt and innocence. The explanation takes the core elements of narrative—the who, what, where, when, how, why—and shows how average people who hear hundreds of stories every day use the connections between these elements to assess credibility. A series of simple experiments outside the courtroom provides evidence for the explanation, showing that there is little relationship between the actual truth of a story and the degree to which the story is believed to be true by an audience of random listeners not familiar with the teller. So, how do jurors make a particular legal judgment? Based on courtroom observation, trial transcripts, and credibility experiments, Bennett and Feldman create a method of diagramming stories that shows exactly what makes some stories more believable than others. Is it Real? is a collection of twenty-eight papers on the most challenging, provocative – and profound – topics related to the quest for real and virtual realities of vision and other senses, and realities that are either constructed or imagined. PATRICKNERHOT Since the two operations overlap each other so much, speaking about fact and interpretation in legal science separately would undoubtedly be highly artificial. To speak about fact in law already brings in the operation we call interpretation. EquaHy, to speak about interpretation is to deal with the method of identifying reality and therefore, in large part, to enter the area of the question of fact. By way of example, Bemard Jackson's text, which we have placed in section 11 of the first part of this volume, could no doubt just as weH have found a horne in section I. This work is aimed at analyzing this interpretation of the operation of identifying fact on the one hand and identifying the meaning of a text on the other. All philosophies of law recognize themselves in the analysis they propose for this interpretation, and we too shall seek in this volume to fumish a few elements of use for this analysis. The present book is based on the conference Software Development and Reality Construction held at SchloB Eringerfeld in Germany, September 25 - 30, 1988. This was organized by the Technical University of Berlin (TUB) in cooperation with the German National Research Center for Computer Science (GMD), Sankt Augustin, and sponsored by the Volkswagen Foundation whose financial support we gratefully acknowledge. The conference was an interdisciplinary scientific and cultural event aimed at promoting discussion on the nature of computer science as a scientific discipline and on the theoretical foundations and systemic practice required for human-oriented system design. In keeping with the conversational style of the conference, the book comprises a series of individual contributions, arranged so as to form a coherent whole. Some authors reflect on their practice in computer science and system design. Others start from approaches developed in the humanities and the social sciences for understanding human learning and creativity, individual and cooperative work, and the interrelation between technology and organizations. Thus, each contribution makes its specific point and can be read on its own merit. But, at the same time, it takes its place as a chapter in the book, along with all the other contributions, to give what seemed to us a meaningful overall line of argumentation. This required careful editorial coordination, and we are grateful to all the authors for bearing with us throughout the slow genesis of the book and for complying with our requests for extensive revision of some of the manuscripts.
