Flou de la prescription avec des injonctions très globales comme le développement économique ou la cohésion sociale, flou des positions dans l'organisation, flou des statuts d'emploi et finalement flou de l'identité et du métier. Pour comprendre ce phénomène, l'ouvrage part d'un constat empirique fait à partir de nombreuses enquêtes dans les secteurs de. l'aménagement, du développement local, de l'environnement et de l'action sociale. Des fonctionnaires vont bien au-delà d'une simple application des réglementations dont ils ont la charge. Ils semblent reconstruire l'action publique à la base en tirant parti de ressources diverses comme s'ils prenaient eux-mêmes en charge les problèmes. S'il y a " prise en charge " et non " application ", c'est que la matière de l'action publique " résiste " et que les finalités publiques ne peuvent être atteintes que par un travail singulier. C'est l'efficacité de l'intervention publique qui se joue alors dans ce travail. L'action publique se trouve alors ordonnée par les " soucis " qui orientent collectivement ces agents publics dans chaque secteur. La bureaucratie ne saurait cependant demeurer en reste et ne cesse de tenter de réinvestir cet espace non contrôlé en multipliant les " dispositifs " qui s'entrecroisent et s'accumulent sans jamais mettre fin à la nécessité de cette prise en charge par un travail. Il se dessine alors les éléments d'une sociologie de la tension entre la prise en charge autonome par les agents et ces dispositifs

The EU has limited legislative competence in the field of social law. However, the Member States are increasingly modernizing social services and social (welfare) protection, attempting to make social services more efficient by increasingly looking to the market for the provision of such services. This policy move brings social services into the radar of EU law. The EU response to this sensitive issue has resulted in a piecemeal and fragmented approach towards the treatment of a new policy area of Social Services of General Interest (SSGI) in EU law and policy. This book is a first contribution towards charting how SSGI have emerged as a special category of SGI in the EU, the reaction of the Member States and stake-holders and how policy is being made through new governance processes, carve-outs and safe havens in legislation and soft law, especially in the light of the new values of the EU introduced by the Treaty of Lisbon 2009. It takes an inter-disciplinary approach and will be of interest to lawyers, economists and political scientists who are interested in EU policy-making as well as practioners, EU and national policy-makers. Ulla Neergaard is Professor of EU law at the Faculty of Law, University of Copenhagen, Denmark. Basic Services for All in an Urbanizing World examines the enormous challenge of ensuring the universal provision of basic services in a world that is being shaped by rapid global urbanization, climate change, and economic, social and technological transformation. The world’s urban population is predicted to reach 5 billion people within the next 20-30 years. The report analyses the conditions necessary for local governments to provide these new urban residents with quality basic services. Water, sanitation, waste management, transport and energy are essential, not only for the preservation of human life and dignity, but also in driving economic growth and ensuring social equality. Each chapter examines a world region, drawing on existing research and consultation with local authorities on the ground.
