This volume contains: - Souverainete territoriale et globalisation des marches: le domaine d'application des lois contre les restrictions de la concurrence, par J. BASEDOW, professeur a l'Universite libre de Berlin. The number of national laws that protect competition against private restrictions are constantly increasing. Their application to trans-boundary situations poses difficult problems for both private international law and public international law. The course deals with both, either with respect to application of the "lex fori" or with respect to application of foreign laws. - Enforcement in the International Context by K.D. KERAMEUS, Professor at the University of Athens. In recent years, enforcement proceedings have gone through a comprehensive reform in many countries. Furthermore, modern enforcement increasingly relies on foreign judgements. The course focuses on three subjects: the comparative element in recent codifications and case-law developments in the area of enforcement: salient and converging trends in the enforcement of foreign judgments on the basis of domestic law or international conventions: and the delimitation of "lex fori"and foreign law during the enforcement proceedings. "Joël Rideau, Professor at the University of Nice-Sophia-Antipolis, underlines in this course that the consideration of the protection of human rights has given rise to the emergence of a human rights protection system in the European Union (Chapter I). In the second chapter, Professor Rideau observes that the development of legal protection of human rights in international law and domestic law constitutes has led to many questions resulting from the coexistence of other systems with the European Union's system. In the third and final chapter of his course, Professor Rideau notes that the emergence of human rights in external relations explains the projection by the Union and the European Communities of human rights values onto the non-member States. Professor Rideau underlines in his conclusion that the coexistence of European and domestic systems of protection within the European Union testify to the importance of protection of human rights accorded by and in the member states, but that this coexistence can cause conflict and complicate the relations between domestic systems on the one hand and European systems on the other"--Publisher's description.
