La autora estudia la denominada asunción espontánea de la deuda ajena o expromisión, un procedimiento mediante el cual un tercero -ajeno a una obligación precedente- asume dicha deuda como propia{ analizando la triple coexistencia de los sistemas que regulan esta institución: el romano-francés, al que se adscribe el Código civil español, que exige que se formule la asunción espontánea vía novatoria con extinción sobre la relación precedente{ el germánico, que desconoce la novación y, finalmente, el italiano que sí recoge -pero no regula- la tradicional novatio, consagrando tres figuras autónomas capaces de modificar con consecuencias extintivas, modificativas o acumulativas al sujeto pasivo.Esta triple coexistencia de procedimientos para asumir la deuda ajena evidencia una dificultad añadida para la futura armonización del Derecho común europeo. La propuesta de redacción del Código de Pavía recoge tanto la novación como la cesión singular de deudas y admite la asunción espontánea de deuda con consecuencias extintivas en el primer caso y modificativas en el segundo. En cuanto a las propuestas del sistema de principios europeo, destaca el deber de colaboración que redunda en beneficio del sujeto pasivo, ya que las partes deben facilitar la plena consecución de la efectividad del contrato.Incluye una extensa bibliografía.
