O objetivo central desta tese é analisar o formato legal e institucional das agências reguladoras no Brasil, no tocante à concepção e às possibilidades de exercício dos direitos da cidadania, no contexto da reforma ultraliberal do Estado, iniciada no governo Fernando Henrique Cardoso, a partir de 1995. Ademais, também foram pesquisados os seguintes objetivos específicos: analisar o contexto histórico que permite o surgimento do "Estado regulador"; analisar o fenômeno dos entes reguladores nos países cujas legislações, doutrinas e jurisprudências forneceram ou deveriam fornecer maiores contribuições; ampliar a discussão a respeito do serviço público, a partir dos antagonismos e das contradições geradas pela prestação desse serviço por agentes privados; descrever os aspectos políticos e institucionais da regulação nas agências reguladoras brasileiras selecionadas; comparar os mecanismos de interface com a cidadania das agências reguladoras examinadas; verificar se a atual relação existente entre os Estados desenvolvidos e os subdesenvolvidos configura um imperialismo de "novo tipo", em que os organismos internacionais e as empresas transnacionais são os principais representantes dos primeiros; revisar a evolução histórica da Administração Pública no Brasil; descrever os fundamentos da teoria da "Nova Gestão Pública" (NGP). Oito agências reguladoras brasileiras (ANEEL, ANATEL, ANP, ANVISA, ANS, ANA, ANTT e ANTAQ) foram selecionadas e analisadas, primeiramente de forma individualizada, e, posteriormente, mediante uma abordagem comparada, buscando identificar, sobretudo, os mecanismos de interface dessas agências com a cidadania. Em conclusão, destaca-se que nenhum desses mecanismos pode ser considerado realmente de participação cidadã, o que caracteriza o déficit democrático do modelo implantado no Brasil.

This book examines the emergence of authoritarian populist regimes, analyzing Brazil as a case study. The authors explain how the tactics employed by the Bolsonaro administration to dismantle bureaucracy and public policies, especially labour and social policies, find expression in the fiscal austerity measures recently inscribed in the Federal Constitution: a counter-democratic device employed by technical and financial elites to systemically derail the social protection system. Through this in-depth case study, the book presents new theoretical arguments and concepts that can be useful to understand the dynamics of such new regimes, and discussing similar cases in other contexts. Democratic governments in Brazil, driven by social movements and political actors, have strengthened social protection through a distinctive institutional architecture that combines the strengthening of public bureaucracies, the creation of intergovernmental networks, and the democratic instances of social participation and agreement. The contributions throughout this volume analyze these transformations in different sectors of public policy, such as labour, employment, pensions, food and nutrition security, health, and social assistance. This collection studies the rise of neutral bodies as a challenge to the constitutional paradigm of the nation state. Administrative entities such as commissions, agencies, councils, authorities or ‘independent agencies’ as they are sometimes known, are relatively autonomous from majoritarian democratic control and by their institutional design fall outside the classical triad of powers or branches of government. They may even fall outside the confines of the nation state itself as with the EU Commission. The book is divided into theoretical-historical and empirical parts. Part I approaches the phenomenon through the rigorous normative conceptual lens of constitutionalism and constitutional law, questioning the implications of political neutrality on inherited normative categories, both at national and supranational level. Part II comprises case-studies reflecting the full spectrum of theoretical frameworks and concerns developed and explored by the theory-oriented chapters in the first part.
