Brazil has a very peculiar tax collection power distribution and revenue sharing system, that splits three way the consumption tax, giving taxation powers over goods circulation to the States, over services to the Municipalities and over production to the Union. The Brazilian State circulation of goods tax, whose regulations require unanimity to incentives and benefits concessions, even though the 27 Brazilian States development state are disparate, generates a "fiscal war" / State competition that costs 30 billion Brazilian Reais (6 billion Swiss Francs) yearly and the attempts at settling State Competition are clearly failing, while Switzerland, which has a similar political organization, seems to have a reasonable and functional system. This dissertation, requirement for the obtaining the title of Doctor in International Tax law, takes a case study approach to compare these two systems, specifically taxable events, financial transfer mechanisms and their rules to avoid State / Canton tax competition to assess if the Swiss system for tax collection power distribution and revenue sharing is a feasible solution to reduce the adverse effects of State tax competition in Brazil.

Approximately 25% of Latin Americans live on less than $2 a day, and Latin America is the most unequal region of the world. Poverty and inequality cause suffering and slow development. The solution must include generating an inclusive development process through satisfying the basic needs of the poor that enhance their productivity, that enable them to contribute to the development process, and that enables them to earn the income necessary to live a full life. Decentralization of taxing and spending from the central government to lower levels of government can help to satisfy basic needs of the poor and create an inclusive development process. However, decentralization is a stepby-step process that must implemented by taking into account real-world circumstances such as a lack of administrative ability in local government, and by formulating policy accordingly. The book derives economic principles for implementing the process of decentralization, and it presents cases that illustrate the principles at work. It is an economic guide for policymakers and practitioners.

Desde el año 2012 el Centro Externadista de Estudios Fiscales ha venido presentando a la comunidad académica diversos textos analíticos con el propósito de divulgar el alcance de las modificaciones al sistema tributa-rio. así como los problemas que se vislumbran en su aplicación y sus eventuales soluciones. En ese sentido, la presente obra colectiva plantea en diez capítulos los principales elementos de la reforma tributaria de la Ley 2155 de 2021, Ley de Inversión Social. que resultó ser un sucedáneo temporal y pragmático ante la fallida propuesta de reforma tributaria del año 2021. El libro aborda las reformas a los impuestos sobre la renta, destacando las dudas que aún existen sobre la determinación oficial de implementar la factura electrónica; los cambios al IVA, particularmente la regulación del día sin IVA; los ajustes al régimen SIMPLE; los mecanismos de recaudo ya comunes en todas las reformas; las reglas que afectan el procedimiento tributario y el mecanismo de obras por impuestos; el beneficiario efectivo y su registro; la reforma territorial y la necesidad de afrontarla sin demora. y los contextos tanto fiscal como económico de la reforma. Hace diez años, so pretexto de la Ley 1607 de 2012, y con la cooperación de la firma Deloitte, un grupo de docentes del Departamento de Derecho Fiscal se embarcó en el proyecto de comentar el texto de la reforma tributaria recientemente aprobada por el Congreso, y sus opiniones fueron recogidas en el primer volumen de la serie sobre reformas tributarias publicado por la Editorial Universidad Externado de Colombia. Desde entonces han transcurrido al menos seis reformas tributarias, sin contar las “pequeñas” modificaciones efectuadas en otras leyes, como las del Plan Nacional de Desarrollo, y en cada una ellas los docentes, los investigadores y los exalumnos del Departamento han ayudado a socializar y de los mandatos del legislador. Esos trabajos que han hecho predicciones de los devenires reglamentarios y jurisprudenciales dieron elementos a los asesores, los jueces y los funcionarios para afrontar la incertidumbre que cada cambio normativo trae, pero, sobre todo, ofrecieron una visión crítica y un seguimiento regular al ejercicio del poder tributario del Estado.
