Refugees are among the poorest people in the world. To date, this group has received relatively little attention in some of the social sciences, especially economics. This book begins to fill the gap by using powerful tools from game theory to better understand the state-level strategic interaction in refugee crises during negotiations for permanent solutions. The three classic solutions to such crises are: repatriation to the country of origin, settlement in the country of first asylum, and resettlement in a third country. Generating such remedies involves assistance from donor countries, and the parties involved often have both common and conflicting interests, giving rise to strategic interactions. As this book shows, game theory is well-suited to such problems. The game-theoretic modelling of negotiations has been an active research area for the past five decades, that started with the seminal work by Nobel laureate John Nash in the early 1950s. This book provides a survey of some of the major developments in the field of strategic bargaining models with an emphasize on the role of threats in the negotiation process. Threats are all actions outside the negotiation room that negotiators have ate their disposal and the use of these actions affect the bargaining position of all negotiators. Of course, each negotiator aims to strengthen his own position. Examples of threats are the announcement of a strike by a union in centralized wage bargaining, or a nation’s announcement of a trade war directed against other nations in negotiations for trade liberalization. This book is organized on the basis of a simple guiding principle: The situation in which none of the parties involved in the negotiations has threats at its disposal is the natural benchmark for negotiations where the parties can make threats. Also on the technical level, negotiations with variable threats build on and extend the techniques applied in analyzing bargaining situations without threats. The first part of this book, containing chapter 3-6, presents the no-threat case, and the second part, containing chapter 7-10, extends the analysis for negotiation situations where threats are present. How is access to asylum and other forms of extraterritorial protection regulated in the European Union? Is the EU acquis in these areas in conformity with international law? Which tools does international law offer to solve collisions between both? And, finally, is law capable of bridging the foundational oppositions embedded in migration and asylum issues? This work combines the potential of legal formalism with an analytical framework drawing on political theory. It analyses the argumentative strategies used by international lawyers, and developed them further, exploiting the interpretative methodology of international law as well as elaborate discrimination arguments. The author concludes that deflecting protection seekers by means of visa requirements may constitute a violation of the European Convention of Human Rights, and that the prescriptions of international law oblige Member States to apply the Dublin Convention and the Spanish Protocol in a manner emptying it of its main control functions. The author also shows that burden-sharing remains the pivotal element in the normative dynamics behind the EU acquis, and explains why the European Court of Human Rights must be regarded as the only transnational forum for the legitimate negotiation of asylum in Europe.

A game-theoretical analysis of interactions between a human being and an omnipotent and omniscient godlike being highlights the inherent unknowability of the latter's superiority. In Divine Games, Steven Brams analyzes games that a human being might play with an omnipotent and omniscient godlike being. Drawing on game theory and his own theory of moves, Brams combines the analysis of thorny theological questions, suggested by Pascal's wager (which considers the rewards and penalties associated with belief or nonbelief in God) and Newcomb's problem (in which a godlike being has near omniscience) with the analysis of several stories from the Hebrew Bible. Almost all of these stories involve conflict between God or a surrogate and a human player; their representation as games raises fundamental questions about God's superiority. In some games God appears vulnerable (after Adam and Eve eat the forbidden fruit in defiance of His command), in other games his actions seem morally dubious (when He subjects Abraham and Job to extreme tests of their faith), and in still other games He has a propensity to hold grudges (in preventing Moses from entering the Promised Land and in undermining the kingship of Saul). If the behavior of a superior being is indistinguishable from that of an ordinary human being, his existence would appear undecidable, or inherently unknowable. Consequently, Brams argues that keeping an open mind about the existence of a superior being is an appropriate theological stance.

How game theory can offer insights into literary, historical, and philosophical texts ranging from Macbeth to Supreme Court decisions. Game theory models are ubiquitous in economics, common in political science, and increasingly used in psychology and sociology; in evolutionary biology, they offer compelling explanations for competition in nature. But game theory has been only sporadically applied to the humanities; indeed, we almost never associate mathematical calculations of strategic choice with the worlds of literature, history, and philosophy. And yet, as Steven Brams shows, game theory can illuminate the rational choices made by characters in texts ranging from the Bible to Joseph Heller's Catch-22 and can explicate strategic questions in law, history, and philosophy. Much of Brams's analysis is based on the theory of moves (TOM), which is grounded in game theory, and which he develops gradually and applies systematically throughout. TOM illuminates the dynamics of player choices, including their misperceptions, deceptions, and uses of different kinds of power.
