De acordo com o Marco de Referência sobre a Dimensão Comercial dos Determinantes Sociais da Saúde divulgado pela OPAS/OMS, a publicidade é um dos principais fatores de disseminação de Doenças Crônicas Não Transmissíveis (DCNTs), o que serve de alerta para os países quanto à necessidade da adoção de medidas restritivas específicas. No Direito brasileiro, apesar de existirem normas que protegem o consumidar da publicidade enganosa e abusiva no CDC (além de um Código de Autorregulamentação Publicitária, aplicável por meio da atuação do Conar), a prática deste controle ainda é frágil. O presente livro busca apresentar um panorama do regime jurídico do controle da publicidade de alimentos ultraprocessados no país e analisar a sua aplicação e suficiência em face de direitos fundamentais como a saúde e a proteção dos mais vulneráveis, tendo em conta a jurisprudência mais atual do Superior Tribunal de Justiça e do Supremo Tribunal Federal.

No presente estudo objetivou-se analisar a possibilidade do controle da publicidade infantil de alimentos de baixo valor nutricional, tendo em vista que a sociedade contemporânea converge para um padrão dietético caracterizado por alimentos ultraprocessados de muita densidade energética, causadores da epidemia global de obesidade e das doenças crônicas não transmissíveis (DCNT), bem como o quadro de sedentarismo evidenciado por parte das crianças. A problematização levantada girou em torno da indagação acerca dos indícios científicos e empíricos de que a publicidade infantil de alimentos de baixo valor nutricional contribui para o aumento das taxas de obesidade e DCNT e se seria possível realizar um controle preventivo através dos instrumentos e funções da responsabilidade civil e das tutelas inibitórias materiais. As hipóteses levantadas demonstraram que devido ao estado inconcluso de desenvolvimento psíquico da criança, a publicidade de alimentos influencia no consumo de tais produtos e, esse modelo de publicidade que se utiliza de técnicas do neuromarketing, marketing sensorial, dentre outras estratégias que se aproveitam da deficiência de julgamento da criança, é uma prática comercial considerada abusiva pelas normas brasileiras, especialmente pelo Código de Defesa do Consumidor, com reconhecimento desta abusividade pelo Superior Tribunal de Justiça - STJ em julgados paradigmáticos e recomendações de organizações internacionais de proteção à criança.
