El actual escenario internacional en Occidente asiste a la crisis del prohibicionismo en materia de políticas de drogas. A la evidencia creciente de la inutilidad del modelo convencional de control de Naciones Unidas, absolutamente contraproducente respecto de los objetivos que se había fijado, se suma en tiempo reciente el surgimiento de iniciativas desde diversas latitudes, tendientes a la regulación de los usos del cannabis.En ese marco, resulta necesario analizar la compatibilidad de las políticas prohibicionistas con los principios fundamentales del Estado social y democrático de Derecho; de allí emergerá el debate sobre el alcance que puede tener la tutela penal de la salud pública, en perspectiva jushumanista.La experiencia uruguaya de regulación de la marihuana se ha tomado como uno de los puntos de referencia para este análisis. Al mismo tiempo, la obra se ocupa de la situación en España respecto del cannabis. Para ello, fue necesario plantear el estado de situación que emerge de su legislación penal en materia de drogas, para luego referirse a las situaciones de conflicto que hoy se desenvuelven ante los tribunales: por una parte, los recursos ante el Tribunal Constitucional contra las leyes autonómicas relativas a marcos regulatorios para los clubes sociales de cannabis, y los fallos existentes al respecto; por otro lado, las sentencias dictadas en los últimos años por la Sala Segunda del Tribunal Supremo relativas a este fenómeno asociativo, de las cuales emerge una polémica tendencia jurisprudencial, ratificada a su vez por el Tribunal Constitucional, en ambos casos con fundamentos anclados en arcaicos paradigmas, ajenos a los principios de dignidad de la persona humana, autonomía personal y derecho al libre desarrollo de la personalidad, que reconoce la Constitución de 1978.

Cannabis is globally the most commonly used psychoactive substance under international control. In 2013 an estimated 181.8 million people aged 15-64 years used cannabis for nonmedical purposes globally (UNODC 2015). There is an increasing demand for treatment for cannabis-use disorders and associated health conditions in high- and middle-income countries. This report focuses on nonmedical use of cannabis building on contributions from a broad range of experts and researchers from different parts of the world. It aims to present current knowledge on the impact of nonmedical cannabis use on health from its impact on brain development to its role in respiratory diseases. The potential medical utility of cannabis - including the pharmacology toxicology and possible therapeutic applications of the cannabis plant - is outside the scope of this report.

For the majority of its history, the cultivation of cannabis did not stand out, at least compared to the cultivation of other illegal plants. Cannabis plantations, like coca bush or opium poppy plantations, were typically large in size, grown by local farmers in a handful of developing (producing) countries, processed and then exported to industrial (consuming) nations. While cocaine and heroin are still produced in a handful of developing countries, cannabis cultivation is increasingly universal. From Europe to the Americas and Oceania, import substitution in cannabis markets has been noticed in almost every developed country around the world, with a notable aversion for discrimination. Geographical, technological, cultural and economic factors help to explain why (indoor and outdoor) domestic cultivation is well established, and why the nature and extent of cultivation varies so dramatically across the western, developed nations. As we start the second decade of the 21st century, the new cannabis industry continues to fascinate both casual and academic observers of the drug scene. Opium smoking was a widespread social custom in nineteenth-century Java, and commercial trade in opium had far-reaching economic and political implications. As in many of the Dutch territories in the Indonesian archipelago, the drug was imported from elsewhere and sold throughout the island under a government monopoly - a system of revenue "farms". These monopoly franchises were regulated by the government and operated by members of Java's Chinese elite, who were frequently also local officials appointed by the Dutch. The farms thus helped support large Chinese patronage networks that vied for control of rural markets throughout Java. James Rush explains the workings of the opium farm system during its mature years by measuring the social, economic, and political reach of these monopolies within the Dutch-dominated colonial society. His analysis of the opium farm incorporates the social history of opium smoking in Java and of the Chinese officer elite that dominated not only the opium farming but also the island's Chinese community and much of its commercial economy. He describes the relations among the various classes of Chinese and Javanese, as well as the relation of the Chinese elite to the Dutch, and he traces the political interplay that smuggling and the black market stimulated among all these elements. This book addresses the use and regulation of traditional drugs such as peyote, ayahuasca, coca leaf, cannabis, khat and Salvia divinorum.
