Chinese as well as European regulatory decisions need to consider regional particularities but insist on an implementation system that never loses sight of its goal. In the area of electronic communications policy, this goal is the establishment of a market environment that ensures innovation, high quality and affordable prices. The present survey aims at improving the process of knowledge exchange between European and Chinese experts and decision-makers in Information Society law and policy. The EU-China Information Society Project asked the authors to assess both the EU's and the Chinese status quo, and to bring together both perspectives together in a joint effort to learn from the EU experiences for the Chinese decision-making process today.

This book presents the most thoroughgoing model yet offered to ensure the emergence of a genuinely competitive electronic communications industry in Europe. In the course of its in-depth analysis the discussion focuses on such factors as the following: EU telecommunications policy as revealed in liberalization and harmonization legislative measures; the EU electronic communications framework; case law covering issues of refusal to supply and the essential facilities doctrine; application of Article 82 EC to bottlenecks; specific types of an undertakings unilateral behaviour that may often occupy NRAs and competition authorities in the context of their ex post competition law investigations under Article 82 EC; strategic alliances and mergers in the move toward multimedia; access to premium content and the emergence of new media; the scope of content regulation in the online environment; and broadband (regulation of local loop unbundling and bitstream access). The book also provides practical guidance on issues concerning the complicated market definition and analysis mechanism promulgated by the European Commission's Recommendation and Guidelines.

Communications and Information in China is a focused analysis of the four fundamentals of the Chinese communications and information sector: dynamic landscape, which includes, most importantly, status, trends, directions, initiatives and characteristics of the Chinese IT and communications industries; policy and regulatory framework, which represents a very hard-to-understand mish-mash of the Chinese political and regulatory structure that has significant impact on where, how and what Chinese IT related industries are heading to; ten most crucial regulatory and strategic issues that derive from China's domestic, political, economic and technological realities and controversies; and foreign involvement, which covers high stakes, critical challenges and contextual forces that international companies face. In-depth discussion also digs into what implications China's telecommunications industry reform and its WTO accession will have on foreign players who are involved in China's enormous but complex IT and communications market.

Telecommunications Policy Making In The European Union written by Joseph William Goodman and has been published by Edward Elgar Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2006 with Political Science categories.

Examining the emergence of a European Union telecommunications policy, Joseph Goodman explains how and why the policy developed as it did and why certain reforms in the sector were easier to achieve than others. He provides a history of the key actors in the policy-making process from the first attempts by the national postal, telegraph, and telecommunication administrations to coordinate their telecommunications policies in the 1950s, to the implementation of a comprehensive EU telecommunications regulatory structure in 1998 and the development of a new regulatory structure in 2003. The analytical framework employed by the author draws upon new institutionalism and actor-based approaches, providing an opportunity to evaluate the utility of a synthetic approach for examining and explaining EU policy-making. The focus of his analysis is on the European Commission's two-pronged strategy of liberalisation and harmonisation, which began in the late 1980s and culminated in an important milestone on January 1st 1998, when the EU Member States fully opened their telecommunications markets to competition. He concludes that a synthetic approach, which enables the researcher to apply a number of approaches to multiple settings and various levels of analysis, is useful - even necessary - in understanding and explaining the many dimensions of EU policy-making. This authoritative study will be of interest to all those in the telecommunications industry - including attorneys, consultants, and lobbyists - who would like to know how the EU's policy developed. It will appeal, more generally, to political scientists and scholars of European history and politics.

The rapid evolution of China from an emerging to a mature intellectual property jurisdiction has far-reaching implications for the law, policy and practice of IP, and their links with competition and technology law. Produced in the year China rose to fourth rank globally as user of the international patent system, this volume is an invaluable guide for the policymaker, the analyst and the practitioner alike, setting a thorough exposition of the substantive law and its application within a broader policy context, and offering a comprehensive, timely overview of an IP system just at the time it begins to assume central significance on the world stage. Antony Taubman, Director, IP Division, WTO This edited volume offers an excellent comprehensive overview of China s intellectual property and technology laws. The eminent contributors to this volume have played important roles in shaping China s IP system and in tackling the many challenges confronting it. By making their views of the system readily accessible to an English audience, this volume will undoubtedly add to our understanding of the legal protections and challenges facing innovation industries in China. Mark Wu, Harvard Law School, US The pioneering studies in this book examine the fundamental role of intellectual property and technology laws as China is moving from made in China to created in China . This book also helps us to understand about the interplay between China s intellectual property protection system and the potential for transition of China s economy, and provides numerous means to deal with the legislative difficulties in China s innovation-oriented strategy. Wu Handong, Zhongnan University of Economics and Law, China Written by some of China s leading academic experts and with a foreword by the former Chief Justice of the IP Tribunal of China s Supreme People s Court, this book combines for the very first time a review of both Chinese intellectual property and technology laws in a single volume in English. The book initially focuses on recent amendments to the laws of copyright, trademarks, patents, before moving on to discuss unfair competition and trade secrets, and the protection of intellectual property over electronic networks. Other chapters cover the regulation of digital networks and telecommunications; IT and E-commerce; the new antimonopoly law and competition; and China s position on the TRIPS agreement. Of special note is a chapter written by in-house Counsel and the Chairman of the Quality Brands Protection Committee (a coalition of well known multinational brands) reviewing both brand protection and practical enforcement of intellectual property in China. This book will appeal to scholars and postgraduate students in commercial law (especially in IP, trade, competition, and technology), Chinese studies and business, as well as regulators, international agencies and law firms. Management consultancy and accounting firms, banks and investment firms will also find this book invaluable.

After decades of liberalization of the telecommunications industry around the world and technological convergence that allows for increasing competition, sector-specific regulation of telecommunications has been on the decline. As a result, the telecommunications industry stands in the middle of a debate that calls for either a total deregulation of access to broadband infrastructures or a separation of infrastructure from service delivery. This book proposes new approaches to dealing with the current and future issues of regulation of telecommunication markets on both a regional and a global scale. This volume represents a valuable compendium of ideas regarding global trends in the telecommunications industry that focus on market and regulatory issues and company strategies. With an international cast of contributors, Regulation and the Evolution of the Global Telecommunications Industry also provides insight into topics including: mobile Internet development, structural function and separation, global experiences with next generation networks, technology convergence and the role of regulation, and the regulatory impact on the balance between static and dynamic efficiencies. The empirical evidence and experiences presented here illustrate the diversity of thoughts and research that characterize this important area of academic and business research. Thus, it will be a critical reference for scholars and students of regulatory economics, policy and finance and researchers and administrators of the telecom industry.
