The institutional and legal status of the WTO, with its integrated dispute settlement system, provides a framework for certainty, security and stability for trade as well as a coherent system to protect intellectual property rights. In all member countries and their respective enterprises, WTO regulations need to be considered when designing and implementing trade-related strategies for business operations in the integrated global market. This book aims at giving upper-level undergraduates and graduate students a comprehensive understanding of the public regulations related to international trade within the WTO mechanism and equip them, as potential policy makers and future practitioners in international trade, with the practical skills to interpret and apply the multilateral trade regulations as outlined by the WTO.

Standards establish a common trading language between buyers and sellers, and ensure public safety and the protection of the environment within and outside national borders. Inappropriate standards and regulations, however, can result in high costs and inefficiencies in trading partner countries as well as in the domestic economy and have international repercussions. These discussion papers focus on transition economies, but inefficiencies also exist in developed market economies and many countries and regional bodies are reforming and upgrading their standards and regulations.

In 2005 the WTO Appellate body ruled that the United States' total prohibition on cross border gambling services was unlawful under the General Agreement on Trade in Services (GATS). The questions raised by the case - whether and how a Government could block service provision on moral grounds - went to the heart of key controversies surrounding international economic law. How do you reconcile a liberal system of international trade in services with national governments' desire to protect social values through service regulation? How much control are the WTO members willing to transfer to the WTO? How much regulatory diversity can the international trading system withstand? This book provides a comprehensive analysis of the regulation of services under the WTO's GATS Agreement. Through a thorough examination of the GATS negotiation history, substantive provisions, judicial interpretation, and ongoing reform process, the book presents a clear picture of how the multilateral trading system justifies and tolerates regulatory diversity. In this respect, the book focuses on the core general principles of necessity and transparency, which would allow the assessment of the consistency with the GATS of domestic regulations in services at a horizontal, cross-sectoral level. In addition, the book reviews with a critical eye the ongoing GATS negotiations on the creation of rules on domestic regulations.

This book evaluates the evolution of regulatory policy in advanced countries and discusses how, due to globalization, policy changes in one country have a knock-on effect in others. Separated in two parts, the first half focuses on policy in developed countries and regulatory diffusion from Europe to Asia. The second part looks at the business impact of policy developments in a number of Southeast Asian countries. Key chapters discuss Thailand's response to EU chemical regulations, the diffusion of private food standards, and the effect of chemical safety standards in Malaysia and Vietnam. These contributions are written by leading scholars in the field and the book is likely to be of interest to students, researchers and policy makers concerned with regulation changes in East Asia.

This book focuses on the PRC’s cross-border data transfer legislation in recent years, as well as the implications for international trade law. The book addresses the convergence of industries and technologies notably caused by digitization; the issue of conflicts between goods and services; and the General Agreement on Tariffs and Trade (GATT) and General Agreement on Trade in Services (GATS) as well as the difficulty of classifying service sectors under WTO members’ commitments. The book also examines the FTAs that entered into force after 2012 that regulate digital trade beyond the venue of the WTO and analyzes their rules of relevance for cross-border data flows and international trade. It asks whether and how these FTAs have deliberately reacted to the increasing importance of data flows as well as to the trouble of governing them in the context of global governance

Export Control Law And Regulations Handbook written by Yann Aubin and has been published by Kluwer Law International B.V. this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-05-15 with Law categories.

The importance of export control laws and regulations in international trade continues to grow, not only because of the increase in world trade and technology dispersion, but also due to concerns surrounding national and regional stability and the risk of terrorism. Accordingly, familiarity with export control laws and regulations around the world has become extremely important for those involved in the international trade of dual-use or military goods, technology, and services. In this preeminent handbook, now in its third edition, two experienced professionals have gathered contributions from expert practitioners and academics. The third edition adds three new country chapters (Brazil, Israel, and Sweden) and a new separate chapter on sanctions and embargoes. In addition to chapters on the international regime in general, the book provides a practical overview of the export/import control regimes covering defence and dual-use goods and services in fourteen key jurisdictions. Country reports each follow the same structure for easy comparison. Issues and topics covered include the following and much more: • import/export legal and regulatory requirements for controlled goods and services; • sanctions for breach of such requirements (civil, administrative, or criminal); • licence application processes; • arms, dual-use and other products embargo (including chemical and biological materials and technology); and • enforcement measures. The Handbook also makes available, through an online application, all important standard export control–related forms, templates, and other related documents, all of which readers can use to draft their own documents. The Handbook is invaluable to any professional (such as lawyers, compliance key players, procurement, logistics, finance and customs practitioners) working in relation to an organisation with a need to know the specific requirements to be followed for the efficient - and legally compliant - import or export of controlled military or dual-use goods, technologies or services.
