Buku ini menemukan bahwa penetapan Qanun Jinayat berlandaskan pada sumber-sumber pokok hukum Islam dan menggunakan berbagai pendapat dalam kitab fikih serta tidak terikat pada satu mazhab. Perumusan Qanun Jinayat ini dipengaruhi oleh latar belakang sosial politik dan pertimbangan fiqhiyah. Dari segi sosial, Qanun Jinayat disesuaikan dengan kesiapan dan kehendak masyarakat Aceh. Kemudian dari segi politik, penetapan Qanun Jinayat sebagai upaya menyelesaikan konflik yang terjadi di Aceh. Sementara dari segi fiqhiyah, Qanun Jinayat hanya mengatur jarimah hudud dan takzir saja agar tidak bertentangan dengan hukum pidana nasional serta dalam penetapan hukum menggunakan mazhab Syafi’i untuk hukum meminum khamar dan mazhab Hanafi untuk hukum zina ghair muh}s}an. Sementara untuk kasus zina muh}s}an dengan hukuman rajam, Qanun Jinayat tidak mengikuti mazhab manapun, tetapi menetapkan hukum dengan ijtihad sendiri. Buku ini menggunakan metode kualitatif, dengan mengumpulkan banyak data yang merupakan bentuk penelitian lapangan (field research) juga menggunakan pendekatan yuridis, historis, dan fikih. Data primer berupa dokumen dan hasil wawancara. Data primer dalam bentuk dokumen adalah Undang-Undang No. 44 Tahun 1999, Undang-Undang No. 18 Tahun 2001, Undang-Undang No. 11 Tahun 2006, Qanun No. 12, 13, 14 Tahun 2003, Naskah Akademik Rancangan Qanun Jinayat Tahun 2008, Notulensi Sidang Rapat Tahun 2008, Rancangan Qanun Jinayat Tahun 2009, Qanun No. 7 Tahun 2013, dan Qanun No. 6 Tahun 2014. Adapun data primer dalam bentuk hasil wawancara bersumber dari para akademisi, ulama, dan anggota legislatif. Data sekunder berupa buku-buku mengenai hukum Islam, fikih, ushul fikih, sejarah perkembangan hukum Islam di Aceh, jurnal-jurnal dan karya ilmiah lainnya yang mengkaji tentang hukum Islam, serta sumber-sumber lain yang relevan. Melalui buku ini diharapkan dapat memberikan manfaat baik secara teoretis maupun praktis. Pada tataran teoretis, materi kajian dalam buku ini dapat dijadikan acuan atau referensi oleh para pembaca, masyarakat, dan pemerhati syariat Islam. The resurgence of Islamic fundamentalism in the 1980s influenced many in the Islamic world to reject Western norms of liberal rationality and to return, instead, to their own tradition for political and cultural inspiration. This rejection of foreign thought threatens to end the centuries-long dialogue between Islam and the West, a dialogue that has produced a nascent Middle Eastern liberalism, along with many less desirable forms of discourse. With Islamic Liberalism, Leonard Binder hopes to reinvigorate that dialogue, asking whether political liberalism can take root in the Middle East without a vigorous Islamic liberalism. But, Binder asks, is an Islamic liberalism possible? The Islamic political community presents special problems to the development of an indigenous liberalism. That community is conceived of as divinely ordained, and its notions of the good are to be derived from scriptural revelation, not arrived at through rational discourse. Liberal politics would seem to stand little chance of surviving in such an atmosphere, let alone thriving. Binder responds to the challenge of Edward Said's critique of Orientalism, of a range of neo-Marxian development theorists, of Sayyid Qutb's fundamentalist vision, of Samir Amin's vision of Egypt's role in the Arab awakening, of Tariq al-Bishri's new populism, of Zaki Najib Mahmud's pragmatism, and the structuralism of Arkoun and Laroui. The deconstruction of these varied texts produces a number of persuasive hermeneutical conclusions that are sequentially woven together in a critical argument that refocuses our attention on the central question of political freedom and democracy. In the course of constructing this argument, Binder reopens the dialogue between Western modernity and Islamic authenticity and reveals the surprising extent to which there is a convergent interest in liberal, democratic, civil society. Finally, in a concluding chapter, he addresses the prospects for liberalism in the three major bourgeois states of Islam—Egypt, Turkey, and Iran.

The distinguished Moroccan philosopher Mohammed Abed al-Jabri, in this summary of his own work, examines the status of Arab thought in the late twentieth century.
