Amtshaftung im Staatskirchenrecht berührt zwei «Exoten»: Die Amtshaftung regelt auf zivilrechtlicher Grundlage die Haftung für hoheitliches Unrecht, während das Staatskirchenrecht typische zivilrechtliche Freiheitsbetätigung in die Formen des öffentlichen Rechts kleidet. Beide Rechtsgebiete kennen Ämter; hier treffen zwei «untechnische» Körperschaftsbegriffe aufeinander, in deren Umfeld Rechtsprechung und Verfassungstext unterschiedliche Pflichten statuieren. Der Autor zeigt, dass Amtshaftung ausschließlich die öffentlich-rechtliche Ausübung staatlicher Ämter erfasst, zu denen kirchliche nicht mehr gehören. Auf sie ist Deliktsrecht (analog) anzuwenden. § 31a BGB greift nicht ein. Dem Kirchenrecht, das als Ergebnis privater Rechtsetzung verstanden wird, bleiben im Haftungsrecht aber Gestaltungsspielräume. Ausführlich wird untersucht, wie weit diese bei Verletzung von Verkehrssicherungspflichten reichen.
