This work studies the development of the institution of the uluma in the Muslim world, with special reference to Shi'ite Islam, in which a semi-formal hierarchy has been in existence since the 19th century. The book examines the emergence of Ithn 'Ashar jurisprudence and its periodic changes, the rise of a Shi'ite learned body, the institutionalization of the positions of mujtahid and marja' a l-taqlid, their financial sources of authority, and finally the political roles of the uluma. It also surveys the long drawn out struggle for authority amongst the representatives of speculative thought in Shi'ism. It includes the challenges of the Sufis, Akhbaris and Shaykhis to the office of ulama, which was successfully empowered with juristic mandate and with the charismatic authority of the viceregent of the Imam.

2007 CHOICE Outstanding Academic Title After the death of the Prophet Muhammad, different religious factions within the Muslim community laid claim to the Prophet's legacy. Drawing on research from Sunni and Shi>ite literature, Liyakat N. Takim explores how these various groups, including the caliphs, scholars, Sufi holy men, and the Shi>ite imams and their disciples, competed to be the Prophetic heirs. The book also illustrates how the tradition of the "heirs of the Prophet" was often a polemical tool used by its bearers to demand obedience and loyalty from the Muslim community by imposing an authoritative rendition of texts, beliefs, and religious practices. Those who did not obey were marginalized and demonized. While examining the competition for Muhammad's charismatic authority, Takim investigates the Shi>ite self-understanding of authority and argues that this was an important factor in the formation of a distinct Shi>ite leadership. The Heirs of the Prophet also provides a new understanding of textual authority in Islam by examining authority construction and the struggle for legitimacy evidenced in Islamic biographical dictionaries.

Ranging from the time of the infallible Imams, to the contemporary era, this book provides a comprehensive overview of Shi’i religious and political authority, focusing on Iran and Lebanon, without limiting the discourse to Khomeini’s version of an Islamic State. Utilising untapped Arabic and Persian sources, Hamid Mavani provides a detailed, nuanced, and diverse theoretical discussion on the doctrine of leadership (Imamate) in Shi’ism from traditional, theological, philosophical, and mystical perspectives. This theoretical discussion becomes the foundation for an analysis of the transmission of the Twelfth Imam’s religious and political authority vis-á-vis the jurists during his Greater Occultation. Bringing the often overlooked diversity within the Shi’i tradition into sharp focus, Religious Authority and Political Thought in Twelver Shi’ism discusses what constitutes an Islamic state, if there is such a notion as an Islamic state. Hamid Mavani further explores the possibility of creating a space for secularity, facilitating a separation between religion and state, and ensuring equal rights for all. This book argues that such a development is only possible if there is a rehabilitation of ijtihad. If this were to materialise modern religious, social, economic, political, and cultural challenges could be addressed more successfully. This book will be of use to scholars and students with interests ranging from Politics, to Religion, to Middle East Studies.

"Contemporary Muslims face the challenge of how can a legal system that was formulated in the classical period of Islam respond to the multitudinous challenges that present-day Muslims encounter? Is there a need for reformation in Islam? If so, where should it begin and in which direction should it proceed? Addressing this gap in Western scholarship, and contributing to the ongoing debate in Islamic scholarship, Shi'ism Revisited: Ijtihad and Reformation in Contemporary Times will: (i) explore how modernity has impinged on the classical formulation of Islamic law, and (ii) analyse how Shi'i jurists have responded to the intersection of shari'a (Islamic law) and modernity. The study is original and ground-breaking in that it seeks to tackle issues such as how Islamic law is being revised by Shi'i scholars on cases such as human rights, gender equality, the rights of non-Muslim minorities, and reconfiguring the rational and moral basis of Islamic law. Such questions have required scholars to apply ijtihad (independent reasoning) in providing solutions to the pressing questions in the religious and social fields. By examining the principles and application of Islamic legal theory (usul al-fiqh) and reformation in Shi'ism, as well as the current discourse on juristic hermeneutics and the basis of a new ijtihad, this research will address topics that have attracted much public attention. Since such issues have been largely neglected by Western scholarship, this book will provide a unique analysis of ijtihad and reformation in the Shi'i world"--

Contemporary Muslims face a challenge: how should they define the relationship between normative Islamic jurisprudence--worked out by classical jurists over the course of centuries-and the reality that confronts them in their everyday lives. They have to reckon with how religion can regulate and serve the needs of a changing community. Is there a need for reformation in Islam? If so, where should it begin and how should it proceed? So far, these challenging questions have received little attention from Western scholars. Shi'ism Revisited will address this gap. In order to address pressing religious and social questions--on topics ranging from women's rights to bioethics and the challenges facing diasporic Muslims--legal scholars have sought to apply ijtihad, or independent reasoning. The lack of a central authority in Islam means the interpretations and edicts of scholars are frequently challenged, resulting in diversity and plurality in Islamic law. This makes Islamic law capacious, but also suggests the critical importance of examining not just the theory of law, but its application. Shi'ism Revisited moves beyond theoretical questions of reformation to address specific ways that Islamic law is being revisited by jurists. Tracing the origins and development of Shi'i jurisprudence and legal theory, Liyakat Takim analyzes how underlying epistemologies can be revised in order to create a moral and coherent legal system.

"Islamic religious authority is conventionally understood to be an exclusively male purview. Yet when dissected into its various manifestations--leading prayer, preaching, issuing fatwas, transmitting hadith, judging in court, teaching law, theology, and other Islamic sciences and generally shaping the Islamic scholarly tradition--nuances emerge that hint at the presence of women in the performance of some of these functions. This collection of case studies, covering the period from classical Islam to the present, and taken from across the Shi'i Islamic world, reflects on the roles that women have played in exercising religious authority across time and space. Comparative reflection on the case studies allows for the formulation of hypotheses regarding the conditions and developments--whether theological, jurisprudential, social, economic, or political--that enhanced or stifled the flourishing of female religious authority in Shi'i Islam."--

Discourse on the topic of Marjaeya, religious authority in Shia Islam, is a frequent topic between practicing Muslims. It is also a topic of intrigue to non-Muslims who are interested in learning more about the source of religious authority and guidance for Shia Muslims. Nonetheless, the greater focus of these discussions have been by Muslims themselves, particularly Shia Muslims. The original Arabic publication of Grand Ayatollah Sayyid Muhammad Saeed Al-Hakeem, Al-Marjaeya wa Qadaya Ukhra, served as an excellent overview of the most pressing issues on the topic. Translating it to English for the benefit of English speakers was a must. This work will allow readers to deepen their understanding of the principles at stake and the driving forces that guide this leadership to guide others. The major theme of this book is authority in Shi`ism with special emphasis on its institutionalization in different historic periods from the beginning of Shi`ism in the Middle Ages to the present. Part I presents new material on important or neglected issues that are at the center of current scholarly debate, including the fundamental relationship between knowledge and authority in pristine Shi`ism, aspects of popular culture in medieval Shi`ism, the institutionalization of religious authority in Shi`ite Iran from the 16th to 18th centuries, and the centralization of religious authority in the 19th century. The editor provides an analysis of the ideological revolution in Shi`ism during the 1970s and 1980s. Important documents and primary sources have been selected for Part II representing the major trends in the history of Shi`ism. With two exceptions, these sources have neither been available in English translation nor easily accessible in the original Arabic or Persian. An extensive introduction by the editor effectively connects Parts I and II of the book.
