The appropriate regulation of the employment decisions of religious schools is an issue of great importance considering the impact that religious schools can have on the wellbeing of many individuals. Religious schools often play a central role in the lives of religious communities by providing religious education and formation to religious adherents, allowing religious adherents to fulfill spiritual and charitable obligations, and acting as a community centre for the religious community to socialise together and meet to discuss issues of mutual concern. They can also make an important contribution to the common good by developing desirable character traits in their students, employees and others involved with the school. Religious schools, however, also have the capacity to harm many individuals in the community by promoting a range of controversial theological and ethical beliefs, and denying individuals the opportunity to be included within religious schools as employees and students. The potential for religious schools to both help and harm members of the community is increasing due to the long term rise in the popularity of religious schools in Australia. The aim of this book is to assess the merits of different approaches to regulating the ability of religious schools to make employment decisions based on an employee's compatibility with the school's religion. The particular focus is on the merits of the general exception approach adopted under the Anti-Discrimination Act 1977 (NSW) that allows religious schools to make employment decisions on grounds that would otherwise be prohibited under the Act. The merits of the general exception approach are considered in relation to two alternative approaches: the inherent requirement test and the opt-in model. The inherent requirement test allows religious schools to make employment decisions on the basis of a person's compatibility with the school's religion for employment positions where a religious component is an inherent requirement. The opt-in model involves a registration process that allows religious schools to adapt the protections provided under the Anti-Discrimination Act 1977 (NSW) to the needs of each religious school.

This collection considers how contemporary cultural and religious diversity challenges and redefines national constitutional and legal frameworks and concepts, within the context of education. It offers a critical reflection on the extent and meanings given to religious freedom in education across Europe. The contributions deal primarily with Western Europe although the book also includes a study of the US vibrant debates on Creationism. This volume considers issues such as religious expression, faith schooling and worship in schools, in a multidisciplinary and comparative approach. The book first examines key concepts, before presenting national models of religion and education in Europe and analyzing case studies relating to religious symbols worn at school and to the teaching of religious education. Legal questions are examined in a wider context, in the light of the intentions of state policy and of current national and transnational debates. Controversies on the legal implications of personal and national identities are for example analyzed. From a comparative perspective, the chapters examine the possible converging power of human rights and anti-discrimination discourses and reveal the difficulties and risks involved in seeking to identify the best model for Europe. This topical study of a highly sensitive area of education presents a valuable insight for students, researchers and academics with an interest in cultural and religious diversity, human rights and education.

A principal forbids same-sex prom dates. A community group tries to prohibit gender-neutral bathrooms. Despite growing acceptance of 2SLGBTQ+ rights, schools still regularly become battlegrounds in clashes between the expression of gender or sexual identity and a perceived threat to religious identity or values. Making the Case explains the position of Canadian law. It demonstrates that Canadians have rights to both religion and rights to gender expression or sexual orientation. It then provides evidence from case law to show that sexual minority rights do not undermine rights to religious freedom. This book is an important tool for anyone working to create an inclusive school environment or respond to rights-based conflicts within the school system.

Written in accessible language, Law and the Wearing of Religious Symbols is a comprehensive analysis of a topical subject that is being widely debated across Europe. The book provides an overview of emerging case law from the European Court of Human Rights as well as from national courts and equality bodies in European countries on the wearing of religious symbols in educational settings. The author persuasively argues that bans on the wearing of religious symbols in educational institutions in Europe constitutes a breach of an individual’s human rights and contravenes existing anti-discrimination legislation. The book offers a discussion of developments in Europe, including the French ban on Islamic head scarves which came into force in April 2011. In addition to an in depth examination of recent bans, the book also assess the arguments used for imposing them as well as the legal claims that can potentially be made to challenge their validity. In doing this, the book will go beyond merely analysing the bans in place to suggest ways in which educational institutions can most fairly respond to requests for accommodation of the wearing of religious symbols and whether perhaps the adoption of other provisions or measures are necessary in order to improve the present situation. This book will be of particular interest to students and academics in the disciplines of law, human rights, political science, sociology and education, but will also be of considerable value to policy makers and educators as well.

Religion is a prominent legal force despite the premise constructed and promoted by Western constitutionalism that it must be separated from the State in democracies. Education constitutes an area of human life that leaves ample scope for the expression of religious identity and shapes the citizens of the future. It is also the place of origin of a considerable number of normative conflicts involving religious identity that arise today in multicultural settings. The book deals with the interplay of law and religion in education through the versatility of religious law and legal pluralism, as well as religion’s possible adaptation and reconciliation with modernity, in order to consider and reflect on normative conflicts. It adopts the angle of the constitutional dimension of religion narrated in a comparative perspective and critically reflects on regulatory attempts by the State and the international community to promote new ways of living together.
