The twentieth century has left behind a painful and complicated legacy of massive trauma, monstrous crimes, radical social engineering, or collective/individual guilt syndromes that were often the premises for and the specters haunting the process of democratization in the various societies that emerged out of these profoundly de-structuring contexts. The present manuscript is a state of the art reassessment and analysis of how the interplay between memory, history, and justice generates insight that is multifariously relevant for comprehending the present and future of democracy without becoming limited to a Europe-centric framework of understanding. This book examines state efforts to shape the public memory of past atrocities in the service of nationalist politics. This political engagement with the 'duty to remember', and the question of historical memory and identity politics, began as an effort to confront denialism with regard to the Holocaust, but now extends well beyond that framework, and has become a contentious subject in many countries. In exploring the politics of memory laws, a topic that has been overlooked in the largely legal analyses surrounding this phenomenon, this volume traces the spread of memory laws from their origins in Western Europe to their adoption by countries around the world. The work illustrates how memory laws have become a widespread tool of governments with a nationalist, majoritarian outlook. Indeed, as this volume illustrates, in countries that move from pluralism to majoritarianism, memory laws serve as a warning – a precursor to increasingly repressive, nationalist inclinations.

Essays in Memory of Jan-Georg Deutsch The volume observes some of the principles that drove Prof. Jan-Georg Deutsch's research: highlighting present-day politics for the way they shape historical remembrance, learning from people on the ground through fieldwork and oral history, and bringing various parts of the African continent into discussion with one another. From Cape Town to Charlottesville, many societies are grappling with historical consciousness and the production of public memory. The yearning for historical justice – that is, for the redress of past wrongs – has become one of the defining features of our age. In this study of the mechanisms of transitional justice in Poland, Frances Millard asks: How does society come to terms with its past? How should it punish the perpetrators of oppression and acknowledge its victims? In the former communist countries of Central and Eastern Europe the task of answering these questions came down to the need to eliminate the communist parties' hold over the state, the economy and society in order to move towards democracy. Millard argues that the key step in achieving this was uncovering the truth about the previous regime's past, prosecuting the perpetrators of past crimes and providing compensation and restitution for its victims. Through the specific case of Poland, Millard provides a comprehensive assessment of the mechanisms and institutions used to achieve this, such as lustration, law enforcement through a Constitutional Tribunal and institutions dedicated to dealing with the past such as the Institute of National Remembrance. Crucially, these processes have assumed new significance in recent years after the Law and Justice Party came to power in 2015, using transitional justice as a tool of political control which has enabled the restructuring of Polish democracy.
