Over the past roughly two decades, the interconnected concepts of reparation, restitution, and commemorative culture have gained renewed momentum – in academic discourse as much as in activist, artistic, and political contexts. This development insists on a critique of the material and systemic conditions of societies and global relations. In their 2018 report on the restitution of looted cultural artifacts, for example, Bénédicte Savoy and Felwine Sarr discuss restitutions in the light of a new ethics of relations. Individual acts of restitution, but also the processes of material and immaterial reparation that go with them, are viewed as mediators in the by definition irreparable legacy of colonialism and its present repercussions. A new ethics of relations might even go beyond anthropocentrism: The destruction of nature in the Anthropocene and the destruction of humanity that is colonialism both require a fundamental questioning of the premises of western modernity and a radically different relationship to the world. The present volume aims to examine different discourses and practices of reparation, bringing together perspectives from cultural studies, memory studies, post- or decolonial studies as well as literary studies. Chapters from these disciplines are complemented by contributions from the fields of philosophy, art, and literature in order to explore the multiple facets of reparation. This book provides detailed analyses of systems that have been established to provide reparations to victims of genocide, crimes against humanity and war crimes, and the way in which these systems have worked and are working in practice. Many of these systems are described and assessed for the first time in an academic publication. The publication draws upon a groundbreaking Conference organised by the Clemens Nathan Research Centre (CNRC) and REDRESS at the Peace Palace in The Hague, with the support of the Dutch Carnegie Foundation. Both CNRC and REDRESS had become very concerned about the extreme difficulty encountered by most victims of serious international crimes in attempting to access effective and enforceable remedies and reparation for harm suffered. In discussions between the Conference organisers and Judges and officials of the International Criminal Court, it became ever more apparent that there was a great need for frank and open exchanges on the question of effective reparation, between the representatives of victims, of NGOs and IGOs, and other experts. It was clear to all that the many current initiatives of governments and regional and international institutions to afford reparations to victims of genocide, crimes against humanity and war crimes could benefit greatly by taking into full account the wide and varied practice that had been built up over several decades. In particular, the Hague Conference sought to consider in detail the long experience of the Conference on Jewish Material Claims against Germany (the Claims Conference) in respect of Holocaust restitution programmes, as well as the practice of truth commissions, arbitral proceedings and a variety of national processes to identify common trends, best practices and lessons. This book thus explores the actions of governments, as well as of national and international courts and commissions in applying, processing, implementing and enforcing a variety of reparations schemes and awards. Crucially, it considers the entire complex of issues from the perspective of the beneficiaries - survivors and their communities - and from the perspective of the policy-makers and implementers tasked with resolving technical and procedural challenges in bringing to fruition adequate, effective and meaningful reparations in the context of mass victimisation.

The robbery and restitution of Jewish property are two inextricably linked social processes. It is not possible to understand the lawsuits and international agreements on the restoration of Jewish property of the late 1990s without examining what was robbed and by whom. Seventy years have passed since the end of the Asia-Pacific War, yet Japan remains embroiled in controversy with its neighbors over the war’s commemoration. Among the many points of contention between Japan, China, and South Korea are interpretations of the Tokyo War Crimes Trial, apologies and compensation for foreign victims of Japanese aggression, prime ministerial visits to the Yasukuni Shrine, and the war’s portrayal in textbooks. Collectively, these controversies have come to be called the “history problem.” But why has the problem become so intractable? Can it ever be resolved, and if so, how? To answer these questions author Hiro Saito mobilizes the sociology of collective memory and social movements, political theories of apology and reconciliation, psychological research on intergroup conflict, and philosophical reflections on memory and history. The history problem, he argues, is essentially a relational phenomenon caused when nations publicly showcase self-serving versions of the past at key ceremonies and events: Japan, South Korea, and China all focus on what happened to their own citizens with little regard for foreign others. Saito goes on to explore the emergence of a cosmopolitan form of commemoration taking humanity, rather than nationality, as its primary frame of reference, an approach increasingly used by a transnational network of advocacy NGOs, victims of Japan’s past wrongdoings, historians, and educators. In the past decade, Jeffrey Olick has established himself as one of the world’s pre-eminent sociologists of memory (and, related to this, both cultural sociology and social theory). His recent book on memory in postwar Germany, In the House of the Hangman (University of Chicago Press, 2005) has garnered a great deal of acclaim. This book collects his best essays on a range of memory related issues and adds a couple of new ones. It is more conceptually expansive than his other work and will serve as a great introduction to this important theorist. In the past quarter century, the issue of memory has not only become an increasingly important analytical category for historians, sociologists and cultural theorists, it has become pervasive in popular culture as well. Part of this is a function of the enhanced role of both narrative and representation – the building blocks of memory, so to speak – across the social sciences and humanities. Just as importantly, though, there has also been an increasing acceptance of the notion that the past is no longer the province of professional historians alone.
