Repensando las amnistías en procesos transicionales es un estudio concebido bajo la perspectiva de tratar de encontrar enfoques correctos y razonables, en la puesta en práctica de las políticas de la conocida justicia transicional en sociedades que intentan resolver graves situaciones de violaciones generalizadas y sistemáticas de los derechos humanos. En especial, que en el diseño y la implementación de la justicia transicional se permita encontrar un equilibrio en el conflicto que suele presentarse entre los valores justicia y paz, dado que la realidad problematizada por conflictos armados o estados dictatoriales no puede ser abordada bajo los tradicionales esquemas de sociedades bien ordenadas y con normales niveles de justicia y paz. El autor defiende el criterio jurídico de que ciertas amnistías con condiciones y limitaciones no implican impunidad sino un elemento de garantía y satisfacción de los derechos de las víctimas.

El presente trabajo está concebido bajo la perspectiva de tratar de encontrar enfoques correctos y razonables en la puesta en práctica de las políticas de la conocida como "justicia transicional", en sociedades que intentan resolver graves situaciones de violaciones generalizadas y sistemáticas de los derechos humanos. En especial, se aspira a que en el diseño y la implementación de la justicia transicional se logre encontrar un equilibrio al conflicto que suele presentarse entre los valores justicia y paz, dado que la realidad social afectada por conflictos armados o Estados dictatoriales no puede ser abordada bajo los tradicionales esquemas válidos para sociedades bien ordenadas y con normales niveles de justicia y paz. Como es sabido, una práctica de Estados y gobiernos consiste en implementar amnistías e indultos o penas reducidas en el marco de políticas criminales blandas en términos de castigos, o que incluso renuncian a los mismos, en pos de superar el conflicto armado y/o la dictadura para que la sociedad logre alcanzar niveles aceptables de paz social. Las amnistías -y no cualquiera- son implementadas en el ámbito de la justicia transicional y sirven como puente para la superación de la violencia generalizada y para lograr la convivencia pacífica.

Few names, apart from that of Leo Strauss, are invoked more often when discussing the American response to terrorism in recent years than that of Carl Schmitt. Schmitt, who was part of the German school of political thought known as the 'Conservative Revolution, ' is widely regarded as having been one of the greatest legal minds of the twentieth century. He famously asserted that the most important function of the sovereign of a nation is not the drafting or enforcement of law, but rather his ability to decide when the law should be suspended in an emergency, and likewise his power to declare who the 'friend' and 'enemy' of a community is at any given moment. Alain de Benoist critiques those who claim Schmitt as an inspiration behind the American 'neoconservative' movement that held sway during the administration of President George W. Bush, showing that the politics of the 'war on terror' do not actually reflect Schmitt's ideas, in that American lack of respect for the traditional rules of war, and its determination to portray its enemies as embodiments of absolute evil rather than as representatives of legitimate polities, renders contemporary American politics thoroughly un-Schmittian. Benoist then goes on to analyse recent history from Schmitt's standpoint, showing that the efforts of the United States have been intended to preserve its global hegemony, whereas Schmitt believed that the world was developing into a multipolar one where many powers, rather than a single power, would dominate, a trend which is clearly at work in our time. Benoist demonstrates that Carl Schmitt was therefore a much greater visionary than the American neoconservatives, who failed to understand the geopolitical forces at work today. Alain de Benoist is the leading philosopher behind the European 'New Right' movement (a label which de Benoist himself rejects, perceiving himself to not fit into the usual Left/Right dichotomy), a metapolitical school of thought which he helped to found in France in 1968 with the establishment of GRECE (Research and Study Group for European Civilisation). He continues to write and give lectures and interviews. He lives in Paris. Arktos has previously made available his books The Problem of Democracy and Beyond Human Rights, both published in 2011.

In Spain between 1936-1945, the Franco regime carried out one Europe’s more brutal but less remembered programs of mass repression. Many were murdered by the regime’s death squads, and in some areas Francoists also subjected up to 15% of the population to summary military trials. Here many suffered the death sentence or jail terms up to thirty years. Although historians have recognised the staggering scale of the trials, they have tended to overlook the mass participation that underpinned them. In contrast to the discussion in other European countries, little attention has been paid to the wide scale collusion in the killings and incarcerations in Spain. Exploring mass complicity in the trials of hundreds of thousands of defeated Republicans following the end of the Spanish Civil War, The Francoist Military Trials probes local Francoists’ accusations whereby victims were selected for prosecution in military courts. It also shows how insubstantial and hostile testimony formed the bedrock of ‘investigations’, secured convictions, and shaped the harsh sentencing practices of Franco’s military judges. Using civil court records, it also documents how grassroots Francoists continued harassing Republicans for many years after they emerged from prison. Challenging the popularly prevalent view that the Franco regime imposed a police state upon a passive Spanish society, the evidence Anderson uncovers here illustrates that local state officials and members of the regime’s support base together forged a powerful repressive system that allowed them to wage war on elements of their own society to a greater extent than perhaps even the Nazis managed against their own population.

This book explores the persistence of the governance gap with respect to the human rights-impacting conduct of transnational extractive corporations operating in zones of weak governance. The authors launch their account with a fascinating case study of Talisman Energy’s experience in Sudan, informed by their own experience as members of the 1999 Canadian Assessment Mission to Sudan (Harker Mission). Drawing on new governance, reflexive law and responsive law theories, the authors assess legal and other non-binding governance mechanisms that have emerged since that time, including the UN Guiding Principles on Business and Human Rights. They conclude that such mechanisms are incapable of systematically preventing human rights violating behaviour by transnational corporations, or of assuring accountability of these actors or recompense for victims of such violations. The authors contend that home state regulation, while not a silver bullet, has a crucial role to play in regulating such conduct. They pick up where UN Special Representative John Ruggie’s Guiding Principles on Business and Human Rights left off, and propose an innovative, robust and adaptable template for strengthening the regulatory framework of home states. Their model draws insights from the theoretical literature, leverages existing public, private, transnational, national, ‘soft’ and hard regulatory tools, and harnesses the specific strengths of state-based governance. This book will be of interest to academics, policy makers, students, civil society and business leaders.
