Constitutional review has become an essential feature of modern liberal democratic constitutionalism. In particular, constitutional review in the context of rights litigation has proved to be most challenging for the courts. By offering in-depth analyses on changes affecting constitutional design and constitutional adjudication, while also engaging with general theories of comparative constitutionalism, this book seeks to provide a heightened understanding of the constitutional and political responses to the issue of adaptability and endurance of rights-based constitutional review. These original contributions, written by an array of distinguished experts and illustrated by the most up-to-date case law, cover Australia, Belgium, Finland, France, Hungary, Ireland, Italy, Spain, the United Kingdom and the United States, and include constitutional systems that are not commonly studied in comparative constitutional studies. Providing structured analyses, the editors combine studies of common law and civil law jurisdictions, centralized and decentralized systems of constitutional review, and large and small jurisdictions. This multi-jurisdictional study will appeal to members of the judiciary, policymakers and practitioners looking for valuable insights into the case law of a range of constitutional and supreme courts in this rapidly expanding field of constitutional adjudication. It also serves as an excellent resource for academics, scholars and advanced students in the fields of law, human rights and political science.

In this set of essays, public lawyers, property lawyers and legal philosophers examine the public dimensions of private property. At a time when governments across the globe are privatising formerly public property, the public forum is being replaced by the privately owned shopping mall, and an increasing range of interests are being described as 'property', an examination of the powers which attach to ownership becomes all the more pressing. The contributors consider whether property is a human right, its role in making responsible citizens, its relationship to freedom of speech and other values, the proper scope of constitutional protections of private property, impediments to the redistribution of property, and attempts to redress historical wrongs by property settlements to indigenous people. Taking a richly comparative perspective, examples have been drawn from jurisdictions as diverse as the United Kingdom, South Africa, Germany, the United States, and New Zealand. Politics in the Republic of Ireland is now available in a fully revised fourth edition. Building on the success of the previous three editions, this text continues to provide an authoritative introduction to all aspects of politics in the Republic of Ireland. Written by some of the foremost experts on Irish politics, it explains, analyzes and interprets the background to Irish government and contemporary political processes. Crucially, it brings the student up-to-date with the very latest developments. New patterns of government formation, challenges to the established political parties, ever-deepening, if sometimes ambivalent, involvement in the process of European integration, a growing role in the politics of Northern Ireland and sustained discussion of gender issues are among these developments – along with evidence, revealed by several tribunals of enquiry, that Irish politics is not as free of corruption as many had assumed.

The Brexit vote for UK withdrawal from the EU has put the constitutional future of Northern Ireland centre-stage once again. Beyond the Border is an authoritative, timely and up-to-date guide to the provisions of the Good Friday Agreement. A compelling and accessible exploration of how the Agreement can be upheld despite Brexit uncertainties, and implemented despite political deadlock, it powerfully argues for the permanence of the Agreement and its cross-community approach, even in the event of the achievement of Irish unity. It comprehensively explains the radical implications of the principle of parity of esteem between the traditions and how the conflicting aspirations of nationalists and unionists can be accommodated. At a time of seismic constitutional transition it outlines the milestones on the pathway to a united Ireland by consent as envisaged by the Agreement. The Good Friday Agreement was endorsed by 71 per cent of voters in Northern Ireland and by 94 per cent in the rest of Ireland. Despite huge difficulties in implementation, this book contends that the Agreement remains a cornerstone of Ireland’s constitutional settlement. Beyond the Border is a vital and objective exploration of how the Agreement provides a peaceful path towards resolving Ireland’s ultimate constitutional dilemma.

The volume Legal Pragmatics is a contribution to the interface between language and law. It looks at how the principles of language use can be beneficial to clarifying legal issues, its twelve chapters (together with the Introduction) offering a wide spectrum of the latest approaches to the area of legal pragmatics. The four chapters in the first section are devoted to historical pragmatics and take a diachronic look at old courtroom records. Written legal language is also the focus of the four chapters in the next section, dealing with the pragmatics of modern legal writing. The chapters in the third section, devoted to modern legal language, touch upon both the discourse in the courtroom and in police investigation. Finally, the two chapters in the last section on legal discourse and multilingualism address a topic very relevant to the modern era of globalisation -- the position of legal discourse in multilingual contexts.
