This book examines in detail the status of children in the EU. Drawing on a range of disciplinary perspectives, including the sociology of childhood and human rights discourse, it offers a critical analysis of the legal and policy framework underpinning EU children's rights across a range of areas, including family law, education, immigration and child protection. Traditionally children's rights at this level have been articulated primarily in the context of the free movement of persons provisions, inevitably restricting entitlement to migrant children of EU nationality. In the past decade, however, innovative interpretations of EU law by the Court of Justice, coupled with important constitutional developments, have prompted the development of a much more robust children's rights agenda. This culminated in the incorporation of a more explicit reference to children's rights in the Lisbon Treaty, followed by the Commission's launch, in February 2011, of a dedicated EU 'Agenda' to promote and safeguard the rights of the child. The analysis presented in this book therefore comes at a pivotal point in the history of EU children's rights, providing a detailed and critical overview of a range of substantive areas, and making an important contribution to international children's rights studies.

This book examines the right to education for migrant children in Europe between 1949 and 1992. Using West Germany as a case study to explore European trends, the book analyzes how the Council of Europe and European Community’s ideological goals were implemented for specific national groups. The book starts with education for displaced persons and exiles in the 1950s, then compares schooling for Italian, Greek, and Turkish labor migrants, then circles back to asylum seekers and returning ethnic Germans. For each group, the state entries involved tried to balance equal education opportunities with the right to personhood, an effort which became particularly convoluted due to implicit biases. When the European Union was founded in 1993, children’s access to education depended on a complicated mix of legal status and perception of cultural compatibility. Despite claims that all children should have equal opportunities, children’s access was limited by citizenship and ethnic identity.

This study, originally published in German in 1983, describes results of a comparative evaluation of Commission of the European Communities projects for migrant children's education in four countries (Belgium, England, France, and the Netherlands). The report begins with a discussion of the European Communities' 1970 directive on the teaching of migrant workers' children, including its background, the debate held about it, the initiation of pilot projects during the debate, and the project methods. Subsequent sections outline, for each of the four country projects, the particular situation of ethnic minority children in the country's school system as a whole and the design of the project to enhance education of migrant children in that country. In each country, the pilot project was implemented in one city. The cities were: Genk (Belgium), Bedford (England), Paris (France), and Leiden (the Netherlands). Next follows a comparative analysis and assessment of the four programs, focusing on two major program aspects: (1) introduction of migrant children to the host country language and culture; and (2) native language instruction. A concluding section discusses the politics of special programs for this population and emphasizes the need for new approaches to the education of ethnic minority children. School segregation still deprives many children of quality education School segregation – one of the worst forms of discrimination – is still an unfortunate reality in Europe today. Its negative consequences affect in particular Roma children, children with disabilities, children with a migrant background and other children due to their social or personal circumstances (such as children living in institutions and children in the juvenile justice system). Despite existing anti-discrimination legislation and policies, the practice of separating groups of pupils in specific schools or classes may even be growing, including as a result of the current increase in the arrival of migrants and refugees in Europe. Many states have adopted important measures to build more inclusive education systems and to guarantee the right of all children to education without discrimination. In practice, however, authorities at national and local level do not always abide by their obligations and often yield to pressure from different sources, including from school administrations, teachers and other professionals and from families. Inclusive education should not be considered a utopian project. It is an achievable goal that has huge potential for improving social cohesion, intercultural relations and the educational opportunities of all children.
