Laduma, Plaintiff, versus Bhevu, Defendant. 1905. 4th Dec. Question of Affiliation. Expert evidence in Native customs. Laduma v. Held, that affiliat-vm, to be valid, should be publicly declared Bhevu. on tlte day of marriaqe; and, in the case of hereditary Chiefs, may also be announced when fixing the relative rank of each wife at the general arrangement of the kraal. Held, that expert evidence is only allowable to describe a tribal custom or local usage, but not with resptct to general native law. (Before Campbell, J.P., Boshoff, J., and Chadwick, J.) This matter first came before the Court in March last, and proceeded to trial, lasting five days. The Court was, however, unable to come to a definite decision, owing to the contradictory nature of the evidence. Almost every material point by the plaintiff was met by counter-statement or flat denial by the defendant and his witnesses. The result was that the defendant was absolved from the instance, and the matter came again before the Court in its present form. The parties are the same as those referred to in N.H.C. Rep., 1899-1900, p. 22; both sons of the late Teteleku, hereditary chief of the Mpumuza tribe. On the occasion referred to, Laduma was declared to be the general heir to...
